Gentlemen: I read with great interest this weekends' New York Times feature story and I look forward to watching your work in the coming years. Here are several cases that merit your immediate investigation. I discuss my background as former Assistant AG (with Kent Markus and Richard Cordray) and Title Insurance Producer in this video and journal entry, which addresses the BoA $335M racism settlement vis a vis the racial steering in Chapter 13/7 Bankruptcy proceedings. The group, known as the Residential Mortgage-Backed Securities Working Group, is part of the Financial Fraud Enforcement Task Force, an interagency outfit created by Mr. Obama in 2009 to prosecute financial crimes.

Despite three years of work by that task force, however, public sentiment still holds that few if any of the real perpetrators of the housing bubble and financial crisis have been held accountable.

Smalley v. Shapiro & Burson -- Court ignored long-established law that Fraud vitiates everything to hold that homeowners who subsequently learn of robo-signing cannot raise the issue after they have lost their cases.

Anderson v. Burson -- Maryland Court of Appeals, up for Reconsideration as Saxon and two different Deustschebank entities lied about the chain of title.

Wells Fargo v. Jeanne Ingress -- False promise by Attorney that he had the original note and mortgage in his desk. NH Judge Diane Nicolosi enters Judgment against Ingress even though there are actually robo-signer Linda Green documents involved.

Marie Miller v. NationStar -- Case dismissed then reinstated, calls for Impeachment of Judge who ignored prior Court Order that NationStar produce the Original Mortgage.

The tone for New Hampshire malfeasance was set by none other than Republican Senator Kelly Ayotte when she was New Hampshire Attorney General. To this day she refuses to investigate the forgery of my name to a mortgage when I was a licensed title insurance producer and she was found negligent in the largest consumer fraud in NH history, the FRM Ponzi scam.

I have written about this case on prior occasion. We are all nestled up tonight finishing 500 Days of Summer and ready to watch Dateline's coverage of Christian Karl Gerhartsreiter's twisted past, which may include at least one murder 3,000 miles away from from Boston, MA. As to Rockefeller/Gerhartsreiter I don't know that Attorney Denner fucked him over on the child abduction case he lost, or if he is a victim of the Court system. Somehow I suspect he just might be guilty.

Now as to Jeffrey Denner's other client, Daralyn Khan, I have reason to believe that he fucked her (ummm... in the carnal sense because she told me) while she was a client, and I think he fucked her over, same way he fucked over Derrick Gillenwater, long story not getting into that right now Google it if you like, but as senior attorney on a project he screwed up. And he is striking out on Daralyn's child support case involving multimillionaire eMusic CEO, Columbia J-School professor, Spence School Trustee and International Felon Adam Klein (Boumat, Ltd) take a read of Judge Dorothy Gibson Journal. Gibson, along with Judges Dilday and Spencer Kagan (a/k/a "Mr. Boobies" watch the video enjoy the pics LOL) have allowed this a felon deadbeat dad to stop paying child support to his unwanted daughter while being a board member at The Spence School -- where his other daughter is in attendance.

KingCast fetishizes over Louboutin v. YSL Second Circuit Trademark Appeal.

As a lawyer who appreciates the feminine form I must say that the ongoing Christian Louboutin v. YSL litigation (Fashionista) is as fascinating as J-Lo's quick recovery at 3:08. Unfortunately I didn't realize I could have caught the oral argument on Tuesday so I will have to wait for the Second Circuit Court of Appeals Decision sometime later this year to see who has stronger footing in this matter. Look at the cast of characters involved here in the right thumbnail, and there are six more amici below the fold that I could not fit on my screen capture. Anyway, I hear where he is coming from, but I'm not sure where he's going.... nor is he at times:

This is a case with far-reaching legal, artistic and intellectual implications and this is not in any way meant to disrespect his arguments. However, I'm just not sure how it can work as a practical matter, and some of this is due to the way his original Trademark was filed, a trifle short on descriptors, i.e. no mention of laquer. Also, can Ferrari sue Nissan for building a swoopy sports car that is indeed, Ferrari red on a Pantone scale? Negative. Could BMW or Jeep successfully trademark their kidney or 7 slit grilles? As a BMW guy I was pissed at Pontiac for its cheeseball copycat Grand Am grille but the answer is no, though I'm sorry for mixing metaphors between color and shape. Not to mention functionality, but that's yet another piece of the puzzle.

Anyway, on the other hand, there are a host of good arguments I'm reading in the Louboutin Reply Brief, three of which interest me the most are secondary meaning, confusion/fair use and irreparable harm, pp. 18, 27. The Lower Court's own words clearly show a manifest secondary meaning that his lawyers at McCarter & English are quick to point out at Fn13 was earned without advertising. The Court in dicta wrote that Plaintiff "departed from longstanding conventions and norms of his industry, transforming the staid black or beige bottom of a shoe into a red brand with worldwide recognition at the high end of women's wear, a product visually so eccentric and striking that it is easily perceived and remembered." Secondary meaning, done.

Next, there is substantial argument about how the experts did their jobs in surveys but in the post-sale context from 10, 20, 30 feet away (pun fully intended) most people would assume they are looking at a pair of Louboutins if they see the bottom of the YSL. Confusion, done.

Irreparable harm is argued because the Court is likely to invalidate the trademark. Therefore, if every high end designer with no pride decided to mimic the shoe they could do so at will, and that would definitely be a Bad Day for Plaintiff. Irreparable Harm, done.

But whether or not the Appeal is ultimately successful remains to be seen. I believe the YSL shoes were all monochrome and if so, does that change anythng? And the fact that Louboutin and YSL have a collaboration history also is intriguing. Query, what would YSL have done if the shoe were on the other foot?

It only makes sense to me that someone in your office maintains that information. I am entitled to the information by law so please provide it so that the taxpayers are spared the cost of litigation. Next up is Anderson v. Burson (listen to my prior interview with Hosea Anderson at bottom) along with the Reconsideration Motion. Soon there will be an in person interview as well. Says Mr. Anderson:

"They lied to the Bankruptcy Trustee and to the Court.... It was just a servicer at the onset, Saxon. Deutsche was nowhere around.... There are two different Deutsche entities, after a while they claimed it was Deutsche America -- but it wasn't.... They then filed a bogus allonge some 9 months later, saying it was Deutsche National.
"Now they have already sold the house and ratified this, but they have made the same mistake all the other courts have. The Court of Special Appeals and the next court have both issued wrong opinions, so they are going to have to address that. We've got them all in a box, they can't issue contradicting affidavits in BK and in the Court of Appeals."

Here is the Mark Meckler case, and here is the Federal Statute that arguably governs this matter, allowing him to transport his weapon in New York. Mr. Meckler's lawyer is one Brian Stapleton, a very bright and dedicated attorney I've known since undergrad in 1984. Both of us are Case Western Reserve Law graduates.

Greg Floyd was a known risk to Law Enforcement, including then-NH AG cum U.S. Senator Kelly Ayotte, who covered it all up and cleared this multiple felon for the murder of Liko Kenney in 24 hours. He then went out and criminally threatened his frail, elderly female neighbor with a gun. Arresting LE and I are pretty cool, and one of them told me "Greg Floyd is a racist whack job, and he will kill again."

If the Feds had taken steps to charge him under 18 U.S.C. 922(g)(1) 12 years ago when the Grafton County Court asked them for intervention (docs coming) we might not have this problem. But the Feds passed -- the Grafton County Superior Court Docket Sheet on Case No. 98-S-242 clearly reflects that the U.S. Attorney's office failed to respond to the same inquiry made ten (10) years ago. They again passed on charging him in 2009 when he turned in yet another weapon. The Statute is 5 years guys, as a former State AAG I respectfully ask that you take action before Hollywood shows you up.

Here is what Kelly Ayotte hid about Greg Floyd, and here is his rap sheet. Moreover, I know that in the following Affidavit (scrubbed from the Internet I will have to repost it) Greg Floyd threatened a school admin with "Mind your business.... I know where you live and the route you take home, and if you're not careful they will take you home in a body bag."

Makes you wonder if he knew the route Liko Kenney took home as well.

Easton Police Chief Robert Every wrote a Search Warrant Affidavit,

"All of us have made mistakes in our lives; in Mr. Floyd's case the behavior extends beyond a mistake; there is a pattern, a pattern of past violence, paranoid behavior and excessive anger. While no one can predict the future, I feel Mr. Floyd is capable of showing up at Lafayette Elementary School or at a neighbor's house with an automatic weapon..."

KingCast says even if Joanna Marinova is a Limited Purpose Public Figure the Boston Herald and Jessica Van Sack Acted with Actual Malice.

Not only that, the Herald's Attorneys, by and through Elizabeth Ritvo, were well aware of it as noted herein. Here is Nicholson v. Promotors on Listings, 159 F.R.D. 343 (1994), readily distinguished:

With respect to the April 11, 1988 article, the only evidence of actual malice to which Mr. Nicholson points shows that Bongiovanni knew of [**9] his reputation in the entertainment community. This knowledge, it is argued, should have put Bongiovanni on notice of the falsity of the allegations. However, the most culpable state of mind this evidence could possibly support is negligence, particularly since the bulk of the article is reporting on an investigation conducted by a reputable newspaper (KingCast note: Unlike the Herald).

With respect to the second article, published on January 16, 1989, plaintiff points to evidence that after the first article, he called and wrote the reporter to put him on notice of the inaccuracies and yet the reporter still failed to call him to verify. Further, he points to evidence that defendants' re-reporting of the information in the Lowell Sun was inaccurate. The only alleged inaccuracy in this article is the use of the word "intensified" in the following sentence: "The local probe into the financial affairs of the LOWELL MEMORIAL AUDITORIUM in Lowell, MA has intensified."

Even assuming that the magistrate judge is correct that there is a disputed issue of fact as to whether this term constitutes a falsehood, and even assuming the reporter may have been negligent in failing to call Mr. Nicholson to hear his viewpoint, [**10] this literary embellishment is not so grossly irresponsible so as to constitute actual malice. [*346] Geiger v. Dell Publishing Co., Inc., 719 F.2d 515, 517-518 (1st Cir. 1983).

.....By way of contrast, the Herald and Jessica Van Sack clearly implied that Joanna Marinova had sex with an inmate, and was somehow punished for it even though she never was even charged. Moreover, the inappropriate touching claim again prison activist Darrell Jones was dismissed... and the Defendants knew as much prior to publication. By any measure of Justice, this case goes to the Jury folks. Accord Shaari v. Harvard Student Agencies, 427 Mass. 129 (1998) citing Branzburg v. Hayes, 408 U.S. 665, 704-705, 33 L. Ed. 2d 626, 92 S. Ct. 2646 (1972). "We feel compelled, therefore, by the Supreme Court's view of the First Amendment to require that this plaintiff's recovery be predicated, in part, on proof that the defamatory statements were untrue."

Here's this weekend's NYTimes story. In sum,

The study has two parts. One used data from actual bankruptcy cases from the Consumer Bankruptcy Project, the most detailed trove of information on filers currently available. The project surveyed 2,400 households nationwide who filed for bankruptcy in 2007.

Results from the second part of the study, which illustrated the lawyer’s influence in determining which bankruptcy chapter to choose, came from a survey sent to lawyers asking them questions based on fictitious couples who were seeking bankruptcy protection. When the couple was named “Reggie and Latisha,” who attended an African Methodist Episcopal Church — as opposed to a white couple, “Todd and Allison,” who were members of a United Methodist Church — the lawyers were more likely to recommend a Chapter 13, even though the two couples’ financial circumstances were identical.

Sadly, there's nothing new here. Racial discrimination in housing was going on since the Warsaw Ghettos in the Old World and on into the hills of Cleveland Heights where we were one of exactly three (3) black families for miles and miles back in 1970. That was related to the landmark case of Heights Community Congress v. Hilltop Realty 774 F.2d 135 (1985), as noted in $335M Bank of America racial settlement journal entry. Bank of America are scum, and Citibank is scum too, that's why POTUS sued them as noted in the previous link. Anyway I discuss related matters with Rod Class at one of his seminars in the short video at top as we discuss how to empower people of all racial, religious or ethnic backgrounds against these morally aberrant and fiscally dishonest banksters.

You gotta explain that nothing is strategic and write an Affidavit that you only recently found out about the connections after due diligence and that August to December is hardly a long time.

You gotta say that the ongoing pattern and spectre of sexual abuse and ongoing coverup is what is paramount here when they try to narrow it.

The bottom line is that there is indeed a potential financial impact to the McCafferty family if the Diocese goes down in this case, and they try to dance around it but it is unavoidable..... and Judge Joseph LaPlante's association seems a tad cozy too, what with using his U.S. Courts email address for contact ....

Also the school never telephoned me back, ahem.... and I love the way they say Patrick J. McCafferty "allegedly" works for St. Thomas Aquinas, LOL.

Joanna Marinova's ongoing Defamation case against the Boston Herald and Jessica Van Sack is headed toward trial or settlement as I noted in this journal entry. After we met on this radio show (watch the movies early summation + TOUCH FM 106.1 show) I took her to down to meet her lawyers and I knew it was going to be a real shit-show that only a top-notch, well-heeled firm could handle and I was right. As you may recall WHDH Channel 7 already settled and issued a public apology for rebroadcasting the filthy lie that Ms. Marinova had snuck into a prison and had sex with an inmate while she was investigating prison conditions with State Rep. Gloria Fox. The 1 Feb. 2012 Motions hearing will be the first KingCast courtroom coverage (read the particulars in the comments section), with Mintz Levin stepping in after it became painfully evident that Attorney Ritvo was involved in the Defamation (IMO) in the first place, just look at the questions that she refused to answer in the Interrogatories, such as "Why was [the Herald's pre-publication review by counsel] done?

Meanwhile, as Dan Kennedy noted several days ago at his Media Nation page, Crystal Cox (online journal) has filed for a new trial in her case for reasons that include the fact that the Judge got it wrong on the issue of whether or not she is a journalist. She is clearly a journalist whether the stodgy establishment and purportedly progressive journos agree. I made that point clear in this journal entry, and when I wrote to her today I mentioned the fact that journos like us are always targets because we are truly independent and will say whatever we feel, as long as it is backed up by some facts. Not one person has ever found one thing I have written in 6 years to be materially incorrect, and I aim to keep it that way, thank you. Frankly, I'm just not going to take any shit from anyone at any time, and I don't have to. It helps that I am a lawyer. It also helps that I am grandfathered in as a journalist to some extent because I have edited a large weekly and reported at a large daily, but even if I had not, the law in many states such as New Hampshire, and the FOIA principles 552(a)(4)(A)(ii) of title 5, United States Code, enunciated herein clearly support my position as a journalist. Then there is the Federal Court ruling that "Plaintiff is an African-American journalist...." (Read up here). And in reality I am no more and no less a journalist than my African-American cousin, Mike Wilbon. It's just that I write about the seedy underbelly of American Jurisprudence and he writes about sports... and rather well I might add, but of course I am somewhat biased, LOL.

Not only that but the entire tone of the story was more like softball city than knock out punch, as it implied that Bank of America picked up Countrywide out of some sense of integrity when in point of fact many are saying that BoA is just as bad, if not worse then Countrywide. All I can tell you is that we are going to get to the nitty gritty with these fools. KingCast Presents Profiles in Domestic Violence: Saving Private Andrews from her husband and from Harrisburg Police.

Note: There is further editing due on this story as I am informed that it is sequentially out of order but substantively correct. Ms. T. Andrews, seen discussing her case with Harrisburg Mayor Linda Thompson's third (or fourth) spokesman Robert Philbin (got it on 1080p Canon 60D video) is in my estimation a survivor of spousal abuse at the hands of Clem Onukwubiri.

"I knew the jig was up," she said... "when I told him I was having problems in the relationship and the first thing he said was 'there's no way you're going to get this house'..... and it was killing me because it was my house to start with," as she pounded the center console of her one remaining car, a Mazda 6 sports sedan. Her other car is a Mazda CX-7 that she bought with part of her life savings is now being piloted by her husband, who convinced her to trade him up from a perfectly good older VW Jetta. Sadly, she has continued to press on through a fight with breast cancer and a very shady husband who has a habit of telephoning other men who know her and harassing them, present company included. Today he was bound over (got it on 1080p Canon 60D video) for a simple assault involving a situation in which he took all of the tools out of her car, forcing her to come back to her home to ask him for the lug wrench for her 2006 Mazda 6. At such point, she claims he attempted to choke her as she stood in the doorway area of her own home. He told her that he has frieds on the police force. I provided him an opportunity to tell his side of the story but he instead brought out his own video camera (one purchased by Ms. Andrews' mother) and began to videotape me, as if I care. I gave him my name and phone number and email adress.

You ask, why is she not living at her own home? Well because she couldn't get the police to take her seriously at any other point in time because they are buddies with her husband. So she couldn't get a TRO or as they call them PFA and she is afraid to return home so she is renting a room from friends. Yes her name is on the Deed, Note and Mortgage and his is not, but the police have told her that PA is a Communal State so what's hers is his and he has an equity interest in the home, presto. According to Ms. Andrews the PD straight out told her as she sought charges on him for another incident, "Clem's a good guy... what did you do to him?"

Thing is, he is not a good guy, he is a compulsive liar in my opinion. He has a criminal past involving charges of sodomy and aggravated assault bumped down from attempted murder that he never disclosed. Also, by coincidence one of my sisters is a Howard University alum and stated that it appears this man never graduated from there but that his brother may have:
"My records only show only one person graduated in 1982 Ndubuisi Onukwubiri...."
Then there is another pending matter that I will not disclose in this space but that prosecutors are aware of. He also never graduated from Howard University as he told her, which leaves me
.....wondering and researching if Fraudulent Inducement and Fraud in the Factum are grounds for Divorce, which by Law will take at least two years in Commonwealth if he contests it.

Anyway she claims the cops then starting singing silly songs with her name in them to her and told her husband "when she hits you we'll come arrest her." Ms. Andrews has filed a Complaint against at least one such officer, which is not good considering the fact that the office is already under fire for a questionable use of force in this recent YouTube video involving an apparently drunken male.

I can vouch for the fact that the Harrisburg PD are unprofessional, just read the journal entries that contain one of my telephone calls to Harrisburg PD along with my commentary about how they hung up on me and refused to provide their names. One of them mocked my concerns about her husbands odd behavior in searching me out to telephone me to discuss her. I've never been friends with him, the whole thing gave me the willies. As such, the two of us filed Right to Know letters yesterday that I will detail over the weekend. Such a shame that middle Pennsylvania is rife with Deadly Domestic Violence over the past year as noted by area journo Diana Fishlock in yesterday's journal entry. We are in touch with her for a follow up. Seems that the Mayor's Office, after ignoring my emails and hanging up the phone on her yesterday (got it on 1080p Canon 60D video) is going to schedule a meeting. Stay tuned. First of all how can YouTube continue to show 309, or 1/10th of the hits I got for the video, "Foreclosure Fraud: Judge and Bankster Caught on Video, Juan B. Colas, Anchor Bank Pt.1." when the graph clearly shows something in excess of 3,000 hits on the video's first day. Now on Wednesday morning 11 Jan it says 2,184 when the YouTube graph clearly shows 3,300 or so, how niggardly.

Similarly, New Hampshire cannot stand to have certain issues publicly aired so they change the rules and coverup, just as did Judge Juan Colas when I journeyed to Madison, Wisconsin yesterday. That is why New Hampshire recently reneged on its Open Court policy with respect to video cameras in Cheshire County, the same place where I had to stomp some heads back in 2006 and where Thomas Ball committed suicide by fire in 2011. The NH Supreme Court recently changed the policy to create a heavy First Amendment presumption in favor of open media access in 2007 if I recall correctly, now Judge Tina Nadeau took it all away in one pen stroke in the Supreme Act of spot zoning.

There was a complete no-show on the hearing scheduled today but no one told the Counter-Plaintiff. The Bailiff/Clerk or Session 8 told us on video that they tried to reach him but that's completely unbelievable because his name and full contact information is of course on file with the Court. He alleges that the same thing happened when Anchor Bank was granted receivership, now I believe him given what I witnessed today. Frankly the U.S. Justice Department should step in because this is ridiculous. I had a brief chat with Judge Colas and another chat Anchor Bank President and COO Mark Timmerman pictured, above (not certain if he still holds that position, see the graph at bottom) at the Executive Office of Anchor Bank. As I walked in with the mighty Canon 60D cranking I saw that my Notice of Media Coverage was the top document on their counter. Watch the video.

Here is your back story on how Anchor Bank and Union Federal have basically stolen money from Mr. R.P. with the express and tacit approval of Dane County Circuit Court Judge Juan B. Colas, pictured at top. My question to him, and to the folks in the executive office at Anchor Bank is simple:

How in the hell can you order or allow receivership when there is no finding of Standing to initiate a foreclosure proceeding ab initio? This is a de facto and de jure violation of basic procedural and substantive due process rights but the Courts, the Attorney Generals and most major media are so beholden to the banksters that they talk a mean game then do absolutely nothing. As to the letters written to the Office of Thrift by the Honorable Tammy Baldwin on a prior foreclosure, more on that later. I have a lot to digest this evening, first of which will be a pan-search dijon salmon platter. The pesto Tilapia with pine nuts and asparagus this afternoon was a definite winner, let's see if my Foodie Spidey Senses ring true again. And oh, my Spidey senses also tell me something is amiss here with Anchor Bank because how could they stay on the skids for so long at $.42 without being delisted, like Fannie Mae and Freddie Mac. He should mop the floor up with Nashua PD's uniforms the same way that Dave Ridley did; the same way that Simon Glik did to Boston PD. And he will, just as soon as he gets his Appeal to a Jury sometime this summer. Judge Bamberger -- the same Judge who issued a warrant in the bogus 2006 seizure of Mr. Gannon's videotapes of Nashua PD police abuse that I will sue for under RSA 91A -- and who on information and belief also signed the warrant for the ill-fated seizure of Mr. Gannon's Chevy Avalanche -- found him guilty of all three pending charges, resisting, assault, disorderly conduct, blah blah blah. Bamberger Petition 7, Bamberger Petition 6, Bamberger v. 4:20 Celebrants.

Now here's the Fun Part: The bicycle cop (and every other cop) today testified about all kinds of profanities allegedly hurled by Mr. Gannon. Too bad all the witnesses I interviewed claim otherwise. Too bad the bicycle cop's police report failed to mention any such obscenities to boot, I got that on video today. A Jury will laugh its ass off over that.

More Fun to be had: Mr. Gannon and his lawyer Justin Shepherd, pictured, basically got a free Discovery session "We all know what's going to happen today," says The Shep as we walk our way to the Execution Chamber... err.... Courtroom. They didn't call any witnesses and they don't have to, and it wouldn't have made any difference to this Judge I can guarantee you that. The Prosecutor, got all kinds of flustered as I walked back into the courtroom as I managed to catch the tail end of a colloquy that started with X/E of the State's only witness, who is a manager at Peddler's Daughter, a known LE hangout.

"It's not a cop hangout," he shrieks.... "I hang out there." Gannon actually spoke up with something like "exactly." Video and stills coming in Due Course, no real hurry and I am crazy busy the next 7 days with mortgage movies and a criminal hearing, both halfway across the Country but I'll be putting something real short together in the next couple days and something very extensive before month's end.

One more thing: Apparently you cannot tell a cop you are acting in self defense even as you have 5-7 LE in your immediate area or the Court may use that against you. Mr. Gannon was maced twice and struck about the head and thorax by Nashua's finest. The guy was out for a walk with his dog. He's not a drinker and I highly doubt he was a physical assailant in this circumstance, just as he wasn't back in 2006 when they stuck a loaded gun in his face at his own door and he took it from them. For those of you who don't believe Mr. Gannon? Why do you think they won't release them? Why do you think they confiscated them in the first place? I will sue for those videos in Due Course, but I figured I would wait for major media to do it first, right.

Boy oh Boy read the January 2012 update, the Bishop's lawyers even lied about the amount of time Judge McCafferty has been on this case!

Details and links later but of course you remember how Judge Paul Barbadoro was so obdurate in telling me "Plaintiff's Motion is absolutely without merit" in the Free Press litigation against Senator Kelly Ayotte, KingCast v. Ayotte, NH GOP and Nashua PD NH Dist 2010-CV-501, watch the courthouse video. This despite the fact that she worked for McLane, Graf -- my opposing counsel Jack Middleton and NH Bar Association President Jennifer Parent were Ayotte's superiors. The links below and the movie above show how Magistrate Landya B. McCafferty slinked out of the case with a back door recusal that was only properly filed after I complained about the ECF notation. To this day the none of the NH District Judges have explained their recusals, although I know that LaPlante has a legitimate reason because of relatives' campaign contributions. In the case below it is because of his affiliation with the Catholic Lawyers Guild as Director.

Now it appears that Magistrate Judge Landya B. McCafferty's husband Patrick McCafferty as employee of St. Thomas Aquinas High School has direct connections with the area Diocese involved in the case of Mary and Thomas Ryan v. Robert T. Krause, 111-CV-00037, all stemming from years of sexual abuse and lies and coverup, some of which I have documented here in another context involving RSA 641:3 lies told by Kelly Ayotte's "hero" Gregory Floyd, whom I believe murdered Liko Kenny. Ryan opted out of a forced settlement and REALLY made some folks very angry. Meanwhile Magistrate McCafferty is of course issuing adverse rulings in the case that I will pull from Pacer later today. I know there is a pending Motion for Recusal against McCafferty and Judge Joseph LaPlante, whom I believe currently is involved with entities like the Catholic Lawyers' Guild, which arguably puts the Bishop of the Manchester Diocese ahead of American Law. But don't ask me, read it for yourself, above.

Phone call today to verify the association and identity and check up on the case law for spouses, but even before I do that I can say it is indeed questionable. McCafferty of course was an Ethics advisor with the NH Bar/Discipline folks. St. Thomas would be far from ecstatic. But what do I know, right. Perhaps Senator Leahy's Office knows better, or at least they know what I know.... perhaps you should ask them because they sure are interested:

2:31p update: No word yet but I know I have met my ethical responsibilities head on. It appears as if Magistrate Landya B. McCafferty has failed on hers under similar circumstances to my case unless the Plaintiffs are suffering under a case of mistaken identity, but somehow I doubt it.

This year I vow to explore new vistas while keeping Lady Liberty close to my mind... and to that end, I ran almost 7 miles yesterday at about an 8 minute mile clip, not bad. I usually run 2-3 miles and hit the gym but yesterday my partner in crime said "Just Do It!"

It does not include the false rape allegations that Brown apparently conjured up, at least to my reading. Here is my first story on it, in para. 2, relating to cases that move forth and back between NH and RI District Courts, such as my Kelly Ayotte/GOP/Nashua PD free press lawsuit that traveled to RI after I busted Landya B. McCafferty for not telling me she worked for McLane Graf. McLane, Graf is the former law firm of Defendant Kelly Ayotte and my opposing counsel Jennifer Parent and Jack Middleton, as if they didn't know better for not telling me that. Parent is NH Bar President for Pete's sake. Now what puzzles me is why the Businessweek writer and editor mischaracterized the settlement as the case being "dropped." There is no Entry. There is a Decision, but no Entry. Which means Mr. Hyman and the Prescotts are still screwed, they just can't appeal it yet. Fascinating.

Well folks almost 1.5 years have passed since KingCast coverage concluded on the Scott Hyman case, as the Jury rendered a record $1.7M Verdict. Every Jewish Holiday I tend to point out the delay in the ruling, as I surmised that Mr. Hyman was going to get screwed.... again.

Well here we go: I recently received notice that Judge Cosgrove, pictured, granted Defendants' Motion for New Trial and to Set Aside the Verdict, basically citing legal incompetence of Defense Counsel. As Negrodamus, I told you many months ago that the arguments set forth by Defense Counsel were grounds for legal malpractice, but certainly not grounds to set aside a Verdict. More on this soon. A burned-out home. Swastikas. Urine. Feces... and now a ruling that smells like excrement, IMO. Defense Counsel gets a Mulligan, try it again. Hang in there Mr. Hyman the Truth will come out and your position (and that of co-Plaintiff Don and Julie Prescott, who also appear in the video at their own home) will be vindicated.

Here is the story at Stopforeclosurefraud. As a First Amendment scholar who has never lost a gag order issue, I love this. I absolutely love it. When U.S. District Court Judge Jerome B. Simandle slammed the spurious gag order request of Phelan, Hallinan & Schmieg in the Charles Giles class action case, he slammed the same dirtbag jackass lawyers who called the police on an innocent homeowner and indie journo, only to have the police take the side of the homeowner, i.e. "We don't know WTF is going on here because no one is answering the door!"

Note further that despite the urgings of his intern as heard in the movie, Senator Menendez's Office has refused to speak with the homeowner or me about what happened that fateful day, nor has he responded to my FOIA request for the information gleaned from regulatory agencies when Menendez, Al Franken and eight (8) other Senators demanded information from said agencies. Time for a follow-up, ahem. Also, I took a quick trip to Pacer and lo and behold, the sewer rats at Phelan, Hallinan & Schmieg are up to the same ole same ole.... in their baseless Motion they threatened sanctions and referenced the David Stern and Baum Law Firms, which recently imploded -- in some way trying to threaten Plaintiffs and counsel in this case. Plaintiff alleges that Phelan Hallinan has the same business model as these other pigs. So now Phelan tries to intimidate as per their general Modus Operandi. I'll download the full documents later but for now read Plaintiff's Opposition Motion p2 below and 3 above, calling attention to the cozy connection between Kenneth Phelan as name partner and as Fannie Mae Chief Risk Officer as government investigations revealed a need for tighter scrutiny over "foreclosure abuses," ahem. Kenneth Phelan and all of his lawyers can go straight to Hell. Don't like it Ken, sue me for Defamation if you want me to hand your ass to you one more time.

Okay so Blue Collar Man Part One featured Styx. But today I am featuring David Byrne, because he takes the most mundane things in life and makes them appear majestic and beautiful. I love his composition and orchestrations, a True Genius and music hero. The fact that his music transcends race and culture is also key. It is so ironic that I have never seen him or the Talking Heads in concert, though I have seen the Tom Tom Club. Maybe it's better that way I probably would have had a damn heart attack from sensory overload. Meanwhile I note that KingCast65 YouTube power to the Proletariat has squeezed past 250K views sometime in December and subscribers are up 42% since April.... without any special promotions and with the Internet mafia keeping me at bay as much as it can. Much more growth to come in 2012.

No.... and in fact is smells more like shit than rose: I bought my Canon 60D and Rode SVM Stereo Mic from B&H Photo and I just recommended the store to more people, notwithstanding the presence of past and current serious Civil Rights cases. It is disturbing. I love my camera though.... but should I continue to support these guys, now that I am aware of these issues, it is giving me serious pause.

The store was sued in 2007 by Hispanic employees who work in the warehouse and were paid less than their Jewish co-workers. The company settled without admitting any wrongdoing, paid out $4.3 million and agreed to regular monitoring by the Equal Employment Opportunity Commission. Currently, seven women are accusing the company of paying female staffers less than their male counterparts -- and reserving the coveted sales positions almost exclusively for men.

Here is your back story.

I see now the Spence school is peeping in.... that is no doubt where Klein sends his preferred daughter. My sister and I went to a great prep school and my parents took responsibility to put us there and to take care of their parental obligations.

But then again neither of my parents are felons.

I'll be in contact with the Spence School tonight via the wonders of Internet travel, soon to be followed by a personal visit as I did at Columbia J-School, I wonder if Adam Klein was honest with them or if his other daughter got partial cab fare.....
