Not bad. I'll run through the bullshit cases they have to present but basically here's the Deal from my First and Second pages rough draft. Here's the KingCast Appellate Brief. Above, the Ayotte First Amendment Free Press case is discussed at various points during my fireside chat with Kevin Avard. Read below the fold for the draft. I am not spending a lot of time on this because there's no need to. Either the Court does the Right Thing and protects the media or it doesn't, simple.

KingCast uses Defendant Roderick Bremby's own Affidavits and Emails to bust him and AG Attorney George Jepsen for Sanctions in Shafer v. Bremby 12-CV-00039 Title XIX case.


Here's that goddamn public information request. 
I haven't received any response from them yet and I emailed it several days ago. 
Chop-chop fellas.

I warned them to quit telling lies and they refused. Now I turn up the heat with the 22 November 2011 email showing I provided the W-1 or whatever it is, along with their own self-contradicting Affidavit from stupidvisor Sylvania Flattery that admits that I provided my mother's bank account information in November, 2011. They caught themselves up on their own lies because case worker Diane Wood said last Friday in her Bad Faith bullshit Affidavit that I had never provided the banking information, in contrast to stupidvisor Flattery who admitted I provided it a long time ago. Whoops. Moreover, I provide an email I saved from Diane Wood in July, 2012 in which I ask here what the holdup is and she says, and I quote:
Unfortunately not. I am getting closer. The problem is there is a huge influx of new ones that at least need to be screened and initial requests made and older ones completed first. It is a never ending battle. I will attempt a.s.a.p.


The jig is up, guys. As I noted in my Reply Memorandum in Support of Rule 11 Sanctions against these lying-assed pigs, there is not one mention of any bank statements, W-1, divorce decree or any other documents due in because they had already been provided. It is oh-so important for them to win this because my reputation as a rebel who, according to some folks (not my clients), doesn't know how to effectively present a case.....But yet and still I have ripped them to shreds and they know it, and they hate it. I'm sure the Court is not too thrilled either but I don't care about any of that. I am here for the Justice and I don't care if they frown at me while they dispense it, I'm used to that. Wait for the movie on this one.

Don't look now but the Boston Globe is apparently researching a story on Judge Gibson, Judge Spencer Kagan or perhaps the whole POS that is the Middlesex Probate Court. It is time for major press to get involved here. They have the money, the power and the ability to influence. See yesterday's related journal entry. Read below the fold to see what the Globe is researching on my journal pages, and watch the movie to see the boobies and the beer-swilling former intern with whom Spencer Kagan discussed pending cases. Small wonder Spence is always asking Jay Korff to ask me to remove this valuable information from the Internet, right.

With Performance Cycles, where I obtained a full service history on Ol' Yaller as they prepare to replace the crankshaft, lovely. Well at least it is comforting to know that the expensive 12K service was completed just before the prior owner rode it to California. I thought the valves sounded good and it just goes like stink. Judge Dorothy Gibson ignores father's simple contempt motion to protect mother in violation, as usual.


Don't look now but the Boston Globe is apparently researching a story on Judge Gibson, Judge Spencer Kagan or perhaps the whole POS that is the Middlesex Probate Court. It is time for major press to get involved here. They have the money, the power and the ability to influence.


The Court Order says "keep your spouse on your medical plan." The wife violates the order for months on end. Judge Gibson ignores her violation and what appears to me to be a well-plead, simple Motion for Contempt. It's just sitting out there, as if Her Honor couldn't care less. Fascinating.

KingCast, Mortgage Movies and Whistleblower Jose Portillo expose the 8,000 fraudulent Shapiro & Burson signatures that must result in substantial Baltimore Circuit Court sanctions.

I am honored that Jose Portillo made Mortgage Movies the first media recipient of this information heretofore shared only with Maryland disciplinary counsel. I am working out a way to inform those who may be affected without overburdening myself with 8,000 emails. Stay tuned. My interview notes with Mr. Portillo are in the comments below.

Here is what happened on the way there: 
A few moments ago I helped a blind man navigate into the Providence, RI MBTA commuter rail. I fucked up at first and led him to the Acela track (the MBTA is usually on this track) then I hooked him up on the other side. I've worked with the blind on a few occasions growing up and as I alternately placed my hand on his back and held his hand in rough traffic I was amazed by how no one else made an effort to give him a suitable berth to swing his cane. I imagined what that would be like to be him, day in day out, and he even held a sense of humor when I was telling him "okay when you get to the top you'll see...." We both broke out laughing. If he is on the train when I get to Boston I will repeat the process; I have a few minutes to spare yo'. So the lesson here is twofold: Be thankful for what you have, and take a goddamn minute sometimes to help those who have less than you. At a minimum, Do No Harm, right. The coolest thing is that when I told him I felt bad that this site was not equipped for the blind he says he has a program that will allow him to follow this journal. Now that's science helping people.

Counsel for Maryland Lawyer Renee Olivia Dyson withdraws in Thomas P. Dore fraudulent foreclosure case.


I will post the thumbnails to the documents over the weekend or Monday. In them, and in the video you see how Dyson tried to avoid answering Discovery requests by claiming that there was no Complaint, but the Court properly slammed Dyson and her lawyer, Rita Ting-Hopper. The larger issue however -- as noted in the recent Thomas P. Dore journal entries -- is that Thomas P. Dore and people like him are ruining America. Recently, Dore was on the Board of the U.S. Foreclosure Network (USFN) and he supports lawless conduct in foreclosure proceedings such as the Teena Cardoni case:  In that case Dore threw her out on the streets in spite of the fact that there was a newborn baby and a grandfather on a respirator in the house and the fraud of Jonathan Feldman and Eastern Savings Bank was involved.  Don't know about Feldman? Just read the Office of Thrift Supervision Cease and Desist Order, which was followed by a monetary punishment of $125K. Meanwhile Thomas P. Dore and the Courts saw to it that Ms. Cardoni never in fact received her hearing pursuant to MD §14-207.1

The simple fact is that the MD Attorney Grievance Commission (ABA Journal link) needs to open up public comment on Thomas P. Dore instead of just having a back door gland hand that hides the true measure of his misconduct.

99 and 86, or KingCast and Ansel Adams demonstrate two different approaches to white balance in the Northwest.

Would you believe that if you know how to play around you will sometimes find that unorthodox approaches to white balance can be good and bad. For example, it is good to use florescent lighting to achieve this monochrome effect on the Puget Sound as CONTROL special agents 99 and 86 continue their fight against KAOS. Other unorthodox approaches to white balance did not fare so well, as Ansel Adams indicates.

KingCast explains why the Union Leader must sue to unseal Eugene Stahl Laurie List info in Cody Eller motorcycle road rage conviction.



The sentencing hearing is allegedly in February. The Motion for New Trial/Set Aside Verdict is still sitting in chambers with an attendant gag order. When you search Pelham Officer Eugene Stahl on this page you'll see the issue. The Union Leader is well aware of the issue and I may mention it next week when we tape Kevin Avard's show in Nashua: The Laurie List debacle is a matter of public interest, and with 60 cops on that list it is a game of Russian Roulette as to when one of them is going to potentially expose the State to some sort of liability. As I note in the video I am disgusted as a former State Attorney, as a former criminal defense attorney and as a past current and future motorcyclist. Anyway here are the State's closing argument segments that I caught on video, and you can clearly see that there is a heavy reliance on Officer Stahl's testimony and credibility. Too bad in the Saviano case a DUI charge was dismissed because of Stahl's conduct in questioning the suspect at the scene.... a similar issue to what is going on in the Cody Eller case. And from what I understand there is yet another more recent case that landed Officer Stahl on the Laurie List.

I say from what I understand because Cody Eller's Motion for a New Trial and to Set Aside the Verdict has been sealed and gag orders on the attorneys are in place. I find all of this to be completely unconstitutional and if I find the time and money I will sue over it. 

The Union Leader has no excuse. They have the time and they most certainly have the money. So where is the intellectual fortitude and Fourth Estate Integrity? On to the closing argument from Kent E. Smith, who is a heavy in the DA's Office.

"It's a simple case either you believe what everybody said in the initial part of this investigation including the Defendant or you believe what Mr. Eller said after he met with his investigators because they are totally different things. Mr. Eller welcomes the opportunity to come up here and to tell his story because he hasn't had the chance to tell his story before -- but that wasn't true he was interviewed by the police at the scene and he could have said anything he wanted to and what did he say I'm not gonna let him pass me. And he was asked did you drive over the line to hit him intentionally he said yes I wasn't gonna let him pass. 

Then we learn he was given the he was given the opportunity to talk to officer stahl shortly after the accident And he agreed to talk to him and then he changed his mind and said no I'd rather talk to my mother first. There was the 300 feet south of Gordon Drive..... That was explained by Officer Stahl that he made a mistake that was backfilled by the computer sistem and it wasn't where he intended to put it in and he owned up to it. that's one of the deals of being a prosecutor you have to try your case with all its warts and wrinkles. You can't make stuff up and we're not trying to tell you he didn't do it wrong he did do it wrong. [The crash] was someplace north of where the defense says the case was predicated on. 

The officer was kind of amazed at this statement as Atty Kaye said this is unusual for someone some up and confess to a crime off the bat did you cross that line into the car and what did ce say yes i did it intentionally i wasn't going to let him pass. still no sign of an SUV....... Would that be something that you would mention to a police officer? Of course it is. When he was given the opportunity to explain Officer Stahl said he waive his Miranda Rights but he would not talk to him because he wanted to talk to his mother, Cody Eller said Oh no I gave him a statement he just didn't write it down. I gave him a statement. There's no grey area there somebody is just not telling the truth..... so that's the way it happened... you know...."

Well in point of fact I don't know..... because to me I think there is substantial question as to whether BOTH of these men are telling the Truth. I'll leave it at that. Well no I won't. Whatever is going on needs to be opened up to the public. I will try to make the time to file a Motion because the major press has not seen fit to do so, therefore it is incumbent on me to do their jobs for them, once again.

KingCast sees Judge Alvin Thompson give DSS wonk Roderick Bremby and his lawyers more time to keep lying; whatever guys you can't make up new facts.


Whatever guys, more time won't change the lies. And don't think I didn't see you snooping around on my journal page because I know every time you're in there, trying to find whatever you can. Anyway the Defendant and his lawyers all know they are telling material lies and that is why I'm preparing my Complaint to the Connecticut authorities regarding bar licensure. The Court may let these clowns get away with things in the limited sense, but in the long run they will rue the day that they sat down to systemically lie about this case.

JUSTICE MYERSCOUGH, dissenting. I respectfully dissent. I would reverse the trial court's award of maintenance as an abuse of discretion. Mary Anne was clearly entitled to additional maintenance. She contributed and sacrificed 33 years of her life as wife, mother, and campaign worker. She now has a much lower present and future earning capacity, unmet needs, greater age, lesser physical and emotional capabilities, and lowered standard of living. 
************I told you some time ago about Judge Reynard allowing a completely fabricated and fraudulent foreclosure case to go forward against a septuagenarian right? You remember grandmother Donna Gaston on the obviously cooked books authored by National City Bank when they falsified her escrow accounts to foreclose on her? Yep. She had already prevailed by proving that she never missed a payment so they invented a new reason after one attorney basically spit in her face and said "I've never lost a foreclosure... and you're not even an attorney.... it's not over yet."

Well you are right about something counselor you got your "victory" but it is not over yet because I'll be coming to document more of this case and the players involved in it.

Judge Reynard sure is involved in a lot of cases as a Defendant, yet they all seem to slip away don't they? Well it appears that much of the pending case against Reynard James Souk -- another dirty prosecutor -- for fabricating and/or withholding evidence is slipping away as well, with the Federal Court refusing to accept intervening law regarding absolute and qualified immunity. That's not just my opinion ask the folks at Justice Denied or at Northwestern's law department as you read the excerpt from Mr. Beamon's Motion to Reconsider:

The controlling law on which the Court‟s decision rested has been fundamentally altered as a result of the Seventh Circuit‟s May 30, 2012 decision in Whitlock v. Brueggemann, __F.3d __, 2012 WL 1939906 (7th Cir. May 30, 2012) (opinion attached as Ex. A). Whitlock affirmed the denial of qualified immunity for an assistant state‟s attorney who fabricated  evidence during an investigation and then went on to prosecute the case using the very evidence that he himself had fabricated.

This was no ordinary film premiere and that's fitting because this is no ordinary movie! Good times, good times... and coming next on Thursday, 10 Jan 2013 to the Cedar-Lee, Cleveland Height's ground-breaking theatre where I worked as a yoot. You Clevelanders will get a kick out of the Mentor Headlands Beach scenes... and I am intrigued enough by the movie to read some new-to-me books by Tao Lin and Brad Warner. Here's the website.

KingCast, Mortgage Movies and Lorayne Souders review the $11.6B Fannie Mae v. Bank of America settlement and First Amended Complaint in Souders v. BoA Central Dist. PA 12-CV-01074.


 WASHINGTON: Bank of America said on Monday it would pay $11.6 billion to settle claims on soured loans sold to government-backed mortgage finance giant Fannie Mae during the home price bubble. Under the agreements, Bank of America Corp. said it would pay $3.55 billion in cash to Fannie Mae and repurchase for $6.75 billion some residential mortgage loans it had sold to the government-controlled firm.

In addition, Bank of America will pay $1.3 billion to address mortgage servicing issues, Fannie Mae said in a separate statement. "A favorable resolution of this long-standing dispute between Fannie Mae and Bank of America is in the best interest of taxpayers," said Bradley Lerman, Fannie Mae executive vice president. Fannie Mae said the deal would compensate it for actual and projected losses resulting from the loans. The loans had been bundled into mortgage-backed securities and bought by the finance giant over 2000-2008, but had not met its underwriting standards.

Unbelievable. And you know this entire collapse was planned, right. Meanwhile I will be posting Lorayne Souder's First Amended Complaint in her case against BoA. Smelling a rat, she went after them for information about her account and they sua sponte accelerated her and moved to foreclose. She was right about the rat, as the top moive indicates that robo-signer Michelle Sjolander was involved with her "loan." Along the way they removed to Federal Court and lied about the day, date and time that they received her First Complaint. Meanwhile Bank of New York/Mellon filed a bogus foreclosure and then released it, and nobody seems to know who had any interest in this, just watch: Lorayne Souders v. Bank of America (Central Dist. KingCast, the family of Hiu Lui Ng and the NYTimes present: Life, Death and Torture in Rhode Island.

Is this the sort of fellow the anti-immigration folks are referencing when they refer to these illegal immigrants and menacing scofflaws? I guess the Unofficial U.S. Policy is to beat them down until they die, then pay substantial court settlements to the grieving family, as if that makes it ok. As you read this, note that the main reason this gentleman was caught up by the system is because a notice to appear was sent to the wrong address. America: Land of the free, Home of the brave. Now I have no idea where the case ultimately was settled because as you can see here his Counsel filed an Oral Motion to Dismiss for lack of Jurisdiction that was apparently granted by my fellow Case Western Reserve alumnus John J. McConnell.

You do remember Hiu Lui Ng, right? If not, read the failed Homeland Security Motion to Dismiss Case No. 07-CV-290ML and Reporter Nina Bernstein will help you:

But when Mr. Ng, who had overstayed a visa years earlier, went to immigration headquarters in Manhattan last summer for his final interview for a green card, he was swept into immigration detention and shuttled through jails and detention centers in three New England states. In April, Mr. Ng began complaining of excruciating back pain. By mid-July, he could no longer walk or stand. And last Wednesday, two days after his 34th birthday, he died in the custody of Immigration and Customs Enforcement in a Rhode Island hospital, his spine fractured and his body riddled with cancer that had gone undiagnosed and untreated for months.


Mr. Ng told his lawyer he was ready to give up, the affidavit said, “because he could no longer withstand the suffering inside the facility,” but Officer Smith insisted that Mr. Ng would first have to withdraw all his appeals. The account of his treatment clearly disturbed the federal judge, William E. Smith of United States District Court in Providence, who instructed the government’s lawyer the next day to have the warden get Mr. Ng to the hospital for an M.R.I. The results were grim: cancer in his liver, lungs and bones, and a fractured spine. “ ‘I don’t have much time to live,’ ” his sister said he told her in a call from Rhode Island Hospital in Providence.

She said the doctor warned that if the family came to visit, immigration authorities might transfer her brother. Three days passed before the warden approved a family visit, she said, after demanding their Social Security numbers. Late in the afternoon of Aug. 5, as Mr. Ng lay on a gurney, hours away from death and still under guard, she and his wife held up his sons, 3 and 1. “Brother, don’t worry, don’t be afraid,” Ms. Zhao said, repeating her last words to him. “They are not going to send you back to the facility again. Brother, you are free now.”
