KingCast presents Iqbal and Twombly lain bare to Politico's Scott Wong and Manu Raju in Kelly Ayotte First Amendment case.
This is a searing video, you bet. And the circumstances justify it. Everyone Plaintiff-side lawyer knows that Ashcroft v. Iqbal and Bell Atlantic Corp. v. Twombly are the Psylla and Chrybdis of Plaintiff/First Amendment/Civil Rights Law. Creepy counsel for Defendants and disingenuous judges who don't want to hear certain types of cases can just send you packing by saying the magic words, "Iqbal and Twombly" even with those cases don't apply to the facts at hand. Then you as a Plaintiff are left to appeal and to hammer your points home and hope for the best, which is exactly what I am doing here in my Free Press First Amendment Appeal in KingCast v. Ayotte, NH GOP and Nashua PD. They beat people involved in videotaping them. They won't dare go there with me but I'm sure some of them would love to, including Defendant Hargreaves. He's a real ass.
While I am of course arguing all portions of the case, including those in which an Iqbal/Twombly analysis could come into play, in my First Assignment of error my point is that a clear cut pattern of disparate treatment obviates any application of Iqbal and Twombly. While I may make it a separate Assignment of Error (I dunno, I wrote these a long time ago and when you revisit them you view them differently) I also argue that it was reversible error for the Court to refuse to allow me to file a Third Amended Complaint because the Nashua Police Department committed certain acts in violation of the First Amendment during the pendency of my case so there is no way I could have raised them earlier. Some of these acts indirectly referenced the First Amendment efforts of Yours Truly in exposing their antipathy toward the First Amendment vis a vis Nashua resident Mike Gannon (and Pamela Reynolds).
It is important for Politico writers Scott Wong and Manu Raju (as well punk-assed NYC writer David Shankbone who makes a cameo in the short film) to understand what is really going on here from someone who has actually won First Amendment trials and helped shape First Amendment Law in Nashua, NH with the help of elected officials no less, as noted in this video. KingCast update amidst Hurricane Sandy: Cody Eller motorcycle road rage jury drawn; Live on-air coverage with Garage 71!
Update: The on-air interview will be published tonight, 30 October 2012. Cody Eller's lawyers committed a tactical error in trying to keep me out, now I made a DVD of the show for filing with the Court showing my professionalism and the fact that I am most definitely not trying to influence a Jury or threaten or encourage bodily harm to Cody Eller. It was an insulting and stupid Motion that will be summarily dismissed. I don't have a First Amendment Nashua Mayoral Commendation, signed off on by all Aldermen because I am unprofessional, right.

Note that by objecting to my coverage the Defendants made it easier for me to cover the case because the Court sent me a copy of its rulings. It held determination on me pending what my intent is (my intent is to professionally cover the event), and it struck the testimony of psychologist Dr. Comisky because information pertaining to him was not timely presented pursuant to Rule 98 (that's a bloody nose to the State BTW) and withheld determination on whether State Trooper Michael Pelletier will qualify as expert witness. Basically the Defendant is claiming that he didn't do a thorough job, but that goes to the weight of his testimony, not whether he can testify. I believe Dr. Mart will testify that Cody Eller did not understand the questioning that night because of auditory and comprehension issues. Everyone clear?

Well truth be known that wouldn't take much at least as far as I'm concerned.
Here is last week's initial coverage. Well actually it's not heating up, it has been hot for a while in various ways, more so on the Republican side. Be that as it may, it sure is compelling to me that candidate Youseff has an open phone line to discuss personal or tax issues whereas candidate Hosmer claims these issues are "unfortunate distractions" from the merits, but then he posts them on his own campaign website! Meanwhile now I think I know why Candidate Hosmer never returned my phone call after his staff promised me an interview: His own potentially dirty laundry was being put out for public viewing by Granite Grok, relative to some au pair or nannies who lived at the Hosmer compound. Whether or not any of that is proved, what is important is Hosmer's disingenuous conduct, both in ducking an interview and in playing both sides of the coin on the personal attacks issue. If he thinks there is substance there and it reflects on Mr. Youseff's integrity then say so. And if not, then take it down from your website and cut the crap.

Writer Michael Volpe knows Kelly Ayotte is a Dirty lawyer and dirty Pol... that's why he covered the Gerard Beloin whistleblower case.

Several months ago I received an email and a call from crime writer Michael Volpe, who was then developing this story about Gerard Beloin, a roofing contractor who is running for U.S. Congress. Writer Volpe's internet research naturally led him to Chris King's First Amendment Page because Mr. Beloin and I have been Internet friends for years. In point of fact I posted on one of Mr. Volpe's journal pages in 2008 on this issue. I have posted information (more) about some of his issues back in the day when Kelly Ayotte was targeting Mr. Beloin and trying and failing to prosecute me for fighting for Civil Rights as NAACP Legal Chair five years ago. Unfortunately for Mr. Beloin he did not fare quite as well and they were able to prosecute him on some bogus wiretap charges stemming from these tape recordings I hosted online for him so you know Kelly Ayotte hates both of us but the real question is, how did Dr. Hieber die? Dr. Not long before he died Mr. Beloin had informed him of the Goffstown High School roofing scam that needlessly cost taxpayers hundreds of thousands of dollars.
You really need to read Mr. Volpe's description of how the whole thing went down at the above "journal pages" link because it was heinous. Double Jeopardy, substantive and procedural due process violations, the whole nine yards. All of this at the same time that Kelly Ayotte was violating the Rules of Civil Procedure in her "case" against me for unauthorized practice of law that went over like a Led Zeppelin. Note that Judge Groff -- the same judge who did the right thing in cutting bail for Mr. Beloin -- found that Ayotte screwed up. Meanwhile it was Judge Diane Nicolosi -- one of the dirtiest Judges I have ever seen -- who locked him up. Nicolosi is prone to letting banks get whatever they want, even when hearsay is evidence and standing to foreclose is not proved:
Be that as it may Michael Bahan as an investigator is a joke; the only thing scarier than that is knowing that my nemesis Judge Paul Barbadoro represented Judge John C. Fairbanks, one of the biggest scumbag Judges the World has ever seen. That's why he died a lonely death in a Las Vegas room with a bag over his head. As for Bahan he's prone to disappearing too. In the event the office so notified does not have jurisdiction of the locale of the accident, it shall be the duty of the officer receiving the notice to immediately give notice of the accident to the office having jurisdiction."
So she did go down to file a report at the end of last week...after I contacted the school and left a note on her windshield, what a massive PITA this whole thing was. In addition to the cosmetics she won't idle now and on a bike that is a HUGE safety issue, it's almost unrideable in city traffic. And the thing is, if you didn't know you struck a 500lb vehicle you shouldn't be driving. And if you did know and you walked, then you should be facing some sort of prosecution (I am reviewing the applicable Statutes) which I look forward to bringing. See you soon.

I have worked in politics on various grassroots levels for years, including the presidential campaigns of Jesse Jackson and Dick Gephardt. President Obama didn't want me because by then folks figured out that I am a loose canon in the sense that I don't pick sides between Dems and Republicans, basically past the State level I have a fundamental mistrust of most of them in the first place, right. Same reason Daily Kos and Firedoglake booted me from their happy little fora.
So anyway I telephoned both New Hampshire D-7 Senate Candidates on Tuesday of this week, seeking responses to a fairly standard battery of questions. My curiosity was piqued when the Democratic candidate failed to respond by today, Friday. Said curiosity was further enhanced with the public allegations of Nannygate issues that I read this morning on Granite Grok. Read the journal entry and watch the short video.... and as promised, as soon as I receive a response from Candidate Hosmer I will post it in its entirety, the same exact way I posted it for Candidate Youssef.
Now then back to DK, some of the biggest asshats I have ever seen in one chat board:
The situation is such that I feel safe to say that if the Dailykos had been operating when Galileo was trying to convince everyone the earth was not flat, I've no doubt he would not have been able to keep his comments from being hidden and/or banned (not that I'm Galileo by a longshot, but I stand by the analogy). The way Dailykos is set up is only useful for maintaining a status quo, it does not seem to encourage talk of paradigm changes, whatsoever. Whether this is an errant structural issue or a conscious effort to control and manipulate things by a few is what is most open to conjecture, imho.LOL, despite the presence of some really nice people, DK and its ilk are all a bunch of Lord of the Flies sort of hangouts. They threw me out for complaining too much about how bad Kelly Ayotte is, now they often write about.... how bad Kelly Ayotte is. I used to care, now I just laugh. Here is a journal entry from six (6) years ago when I cared.

The sentencing hearing is allegedly in February. The Motion for New Trial/Set Aside Verdict is still sitting in chambers with an attendant gag order. When you search Pelham Officer Eugene Stahl on this page you'll see the issue. The Union Leader is well aware of the issue and I may mention it next week when we tape Kevin Avard's show in Nashua: The Laurie List debacle is a matter of public interest, and with 60 cops on that list it is a game of Russian Roulette as to when one of them is going to potentially expose the State to some sort of liability. As I note in the video I am disgusted as a former State Attorney, as a former criminal defense attorney and as a past current and future motorcyclist. Anyway here are the State's closing argument segments that I caught on video, and you can clearly see that there is a heavy reliance on Officer Stahl's testimony and credibility. Too bad in the Saviano case a DUI charge was dismissed because of Stahl's conduct in questioning the suspect at the scene.... a similar issue to what is going on in the Cody Eller case. And from what I understand there is yet another more recent case that landed Officer Stahl on the Laurie List.
I say from what I understand because Cody Eller's Motion for a New Trial and to Set Aside the Verdict has been sealed and gag orders on the attorneys are in place. I find all of this to be completely unconstitutional and if I find the time and money I will sue over it.
The Union Leader has no excuse. They have the time and they most certainly have the money. So where is the intellectual fortitude and Fourth Estate Integrity? On to the closing argument from Kent E. Smith, who is a heavy in the DA's Office.

Trial Day One.
Older Eagle Tribune story. Seems like Major Press has fallen off the case, but it would be just like them to return now for the trial and then force me to accept their limited and pooled video because most courts allow only one video camera at a time. Anyway, I went to run video of Cody Eller but that court session was just completing as I arrived and then Attorney Ross McLeod (pictured) and Jeffrey Kaye ran interference hard core outside, good job guys, just watch your step because Attorney McLeod got a tad too aggressive out there, no need for that, bro. Trust me I won't get right in your client's face and you won't get right in mine again either. Anyway there is another Motion Hearing on Tuesday I will likely attend, and then the trial, stay tuned.
4:50p Friday -- Attorney McLeod and I just spoke at length and we are totally chill. We discussed Cody Eller's mens rea and various pending issues I will describe in greater detail tonight. He also has watched and enjoyed KingCast videos on other matters LOL. The best colloquy:
"You play (American) football?"
"No, soccer.... defense."
"You did a good job!"
And yes, Attorney McLeod and I both know how full of crap (press release) Kelly Ayotte and Mike Delaney are (Eagle Tribune 10 Oct. 2012) really are, LOL. And BTW just this weeks some asshole in a Volvo backed over my bike and kept on going, so no, I am not inclined to be giving out sympathy for Cody Eller's predicament of potentially losing driving privileges for a time. It is a privilege, not a right. At least in my situation a private detective and his wife saw it, and gave me their contact info and I will track her ass down. Talk about the wrong guy's bike to hit, Jesus.
PS: And a Volvo no less, I grew up in those cars, I even bought one before I went German.
