KingCast Presents: Mile Three.

Just checking my levels and such, I'm not too far off. More performance-oriented sounds when I return to Boston next week. I am thinking the Rode SVM in the backpack can be synched with the Go Pro when I get it and give the best sound/video. Stay tuned for some nice spring and summer riding scenes.

KingCast says "whoopsie-daisy" as truck driver knocks street lamp into bedroom window on Boston's south side.

There's never a dull moment on my street, mundane as it may seem. And it is usually something electric related, as it was a couple of years ago when the lovely Jennifer Egan interviewed me on power outages the night it was so hot I slept on the porch, LOL. Video soon.

KingCast cameras attend Clifford Pisano Revere CERCLA EPA 21E TRO hearing, matter is taken under advisement as the city of Revere ignores a valid summons (not subpoena, sorry).


Clifford Pisano is a fighter... and he has fought for his own life after being savagely attacked as a young boy and left for dead, with his skull split open. So next to that, the shenanigans he sees at Revere City Hall are, ahem, more akin to child's play. 
Cliff's my brother. You mess with Cliff, you mess with me.

By the way in her Denial of Mr. Pisano's Motion for Immediate Injunctive Relief Her Honor never specifically mentioned the FACT that contamination is present and that testing had occurred in May, 2011 even though that much is clear by the filings. This is important as to how the City handled this whole issue because City Councilor Ira Novoselsky was aware of the testing and was present at the Developer's meeting yet no mention of actual contamination was ever noted in the City Zoning files and approval. Then the Court called me a "self-described journalist," query what does that mean? Does it mean that I am a self-described journalist because I quit working at the Indianapolis Star to go to law school?
That doesn't make any sense. But then neither do the (in)actions of Ira Novoselsky.

Substantial back story. The key here is that the City of Revere was a no-show. What happens when you or I get a subpoena and don't show up to Court? Trouble. Well in my case with respect to being subpoenaed by the Boston Herald in Joanna Marinova v. Boston Herald & Jessica Van Sack the subpoena was quashed, but whatever. Sooo..... you make sure you have the latest and greatest.... and it sucks, and I mean absolutely.... sucks. Completely unusable. I have work to get done and boy am I glad that I didn't trash iMovie. Apple get your shit together because it's not just me saying this.

KingCast watches as Clifford Pisano goes toe-to-toe with Revere, MA developers on Standing to sue regarding contaminated property at 525 Beach Street: He's a taxpayer concerned about his health.

11:00 a.m. Pre-Hearing Update: MASS EPA reps told me today that the developers told him there are indeed reportable levels of contamination at 525 Beach Street, Revere, MA.... the site of an old gas station, auto body repair and car dealership. And of course remember that Mr. Pisano saw ground being broken in the building late last year folks...... but no one has sent information to the EPA.
No surprise there on the contamination, but what is surprising is why this information was not set forth to the city during the planning or zoning phases, given that testing was done back in It has been 103 days since Beach Street Limited Partnership acquired the property for $750K I believe (an incredible markup in a downward economy BTW look at the history) so they are within the 120 day reporting rule but why wasn't this made public back in May, 2011, I wonder? And why didn't the prior owner report to MASS DEP or to the City during Site Plan Development or Zoning Approval. I can't wait to see the dates on the reports today in Court. Remember, testing was done in May, 2011 with City Councilor Ira Novoselsky aware at all times, according to the Developer's website and it doesn't take that long -- none of this is rocket science folks. I was a zoning manager and my father put me through prep school running a Varian gas chromatograph okay, right.

As one can see from this Boulder, CO environmental web page, gasoline seepage creates quite an environmental hazard. The ancient 2000 gallon cast iron tank most likely leaked quite a bit in its 60 years, not to mention the other chemicals used or dumped on site while 525 Beach Street served as a car dealership and auto body shop back in the Day. Like I say, my father retired as an environmental chemist so I keep up on things like this, right. That helped pay for my prep school education, so I have to use it wisely, right. It sure would seem prudent to produce the test results to assuage Mr. Pisano's concerns now, instead of engaging in more litgationand obfuscation now, wouldn't it? But noooo......

Back story and more back story. And of course we also smoked the snooty Suffolk Superior Court clerk when he tried to shut down the mighty KingCast Canon 60D. Mr. Pisano's people have helped him prepare a Motion for Injunctive Relief (TRO) that will be heard Wednesday at 2p. Meanwhile the Developers have moved for an expedited ruling that he lacks standing because he is a renter and not a homeowner. Well to me that's kind of sleazy because all he is seeking at the damn TRO hearing at this point are the results of the testing that he discovered HAS BEEN COMPLETED: 
Where are we in the process?  What’s the big picture and the likelihood that this will happen? The site is under agreement for CND and we are currently doing some testing on site to determine how much environmental remediation will be called for.   The results will inform our decision to buy the property or not.  More on this later.
More on this later they say.... well dammit it has been a year is that later enough guys? I've had enough of this crap and so has Mr. Pisano, just straight shoot or shut your mouth, I say. As noted in this journal and in several KingCast short films, City Councilor Ira Novoselsky was present nearly an entire year ago at a developer's meeting at which the representation was made that testing was "being conducted." As noted, these results were never made public to anyone, and given the fact that the public welfare, including health is involved, and whereas the consequences of a rotting gas tank can be severe, and whereas the soup kitchen people told him that they moved from 525 Beach Street because of contamination, a reasonable Jurist would find that he has standing. He is also named in his parents' will at his home, which abuts the subject property. This is going to get interesting real fast, and you can watch it all play out right here at KingCast.net


As to Standing on environmental nuisance, we have Joyal v. Marlborough, 3 Mass. L. Rep. 379 (1995) (cited herein) residents have standing, irrespective of whether they own their homes or rent. HN1 Mass. Gen. Laws ch. 214, § 7A empowers the superior court to enjoin damage to the environment as long as certain prerequisites are met. The court also has general equitable powers to enjoin nuisance. Mass. Gen. Laws ch. 241 § 1 and Mass. Gen. Laws ch. 241 § 5. Try again guys LOL. Just cough up the records.


See also Everson v. Board of Education - 330 U.S. 1 (1947) and Policastro v. City of Boston, 20 Mass. L. Rep. 273 (2005) -- because their own documents indicate that there is an actual expenditure -- not merely tax credits -- he has standing. And oh, as seen by the thumbnail below, Clifford Pisano's father -- otherwise known as the homeowner -- gave him express permission to speak on his behalf. And the property is willed to him as well. Can you say "substantial interest?" Here is the Policastro nugget of Truth:
Here, treating the factual allegations in his Complaint as true, Policastro has alleged sufficient facts to place him within the area of concern of the Establishment Clause and the Anti-Aid Amendment. As a resident taxpayer of the City of Boston, Policastro has the right to contest the sale of publicly owned land at a below-market price to a religious institution for the purposes of operating a house of worship and the endorsement of a particular religion and excessive entanglement created by the establishment of a particular lecture program at a public college.9
While Policastro was decided in a religious/establishment context it sure would seem inappropriate for a court to dismiss his concerns in this instance now, wouldn't it? Whatever the case, why not just produce the test results? I asked for them, the EPA has asked for them, Clifford Pisano asked for them and they bragged about conducting the tests on their own website. As for the expedited hearing, Mr. Pisano need not answer that Rule 9A Motion for another 9 days or so, but they will have to appear in Court on Wednesday. Looks like he out-expedited them, huh.  They can run but they can't hide.

KingCast takes to the court, 2012 pt. 2: It gets no better -- Wilson K Surge v. Wilson Nano 6.1


I cannot believe I used to swing a big-assed, heavy 6.0 Sampras Pro Staff. Unless you are on top of your game and strong as hell, there is an easier, softer way LOL. It's called the Wilson Surge, a K Surge in my case. Tonight I broke a string, didn't bring my backup so grabbed the 6.1 which also had a bigger handle without the grip that I like so that did not help either. Anyway I will make sure to have fresh strings and both rackets next time.

ACLU Watches as KingCast and Revere's Clifford Pisano Deliver a First Amendment Smackdown to a Snooty Suffolk County Court Clerk.

Oh you better believe I brought my A Game today, I knew this guy was going to be a real schmuck.... and he proved me right. I am a good judge of character. He then had the nerve to ask his boss whether I was an attorney and his boss said "Oh yeah he's an attorney...." 


As if that matters. Whatever, I've earned that alphabet soup buddy, you go ahead and get yours if you can, bro but don't you ever mess with me again because I will smoke you every time, are we clear? I don't even know your name and guess what, I don't even care unless I decide to name you in a lawsuit, then I will find out you got that right. Now then, the message I am giving all journalists, J.D., Esq. or not -- is that there is no need to suffer any abuses against the First Amendment. As a former State Attorney I'm not having it. Not yesterday, not today, not ever. Here is some of the back story.

Today's run, 5.5 like it was nothing. I'm not saying I felt like doubling up or running a half-marathon or anything but it is good to know you can put down 5-7 miles at the drop of a hat and then work out a bit. One day my curious nature will lead me to double up though just to say I did it. At that point I probably will be hurting, but whatever it's All Good. It is going to be a great summer season!

KingCast Gets a New Front Tyre... or Saving Bessie from the Ghetto.

Before I rode off to get another Dunlop Sportmax Q2 for Bessie (I'm hooked on these) I stopped to reflect prospectively -- on upcoming video -- on what I need to do to keep her from becoming queen of the ghetto. It ain't pretty, but regardless of that when you get her out on the open road she is a total thoroughbred, and it is amazing what a few new millimeters of rubber will do for your ride.

And of course you remember Revere, MA abutter Clifford Pisano's ongoing attempts to obtain the testing information at the contaminated building next door to his home? Here is the 525 Beach Street summary at the Chelsea Neighborhood Development website. Remember how earlier this week I proved that the Developers said testing was being completed nearly a year ago, in May, 2011 yet none of that information made it into site plan approval or zoning application or variance approval? Well the EPA's Steve Johnson is currently trying to obtain this information because gosh knows no one is providing it to Mr. Pisano, the City of Revere, or Yours Truly. Well take that back: They might have provided it to the City and they might have squashed it. Query, what are the levels of contamination from the 1924 cast iron 2,000 gas tank that was there for about 60 years? Not to mention the other solvents that were used by the car dealers & body shops..... enquiring minds want to know!

Catholic Diocese lawsuit: KingCast applauds Mary Ryan for becoming the second pro se litigant to force recusal of U.S. Magistrate Landya B. McCafferty for appearance of impropriety.

Oh you better believe this is some serious business: In my First Amendment Free Press case, KingCast v. Kelly Ayotte, NH GOP and Nashua PD NH Dist. 2010-CV-501 (see related video at link) I made Landya B. McCafferty recuse herself because of her well-documented ties to my opposing counsel at McLane, Graf. She did it on the Down Low as R Kelly and the Isley Brothers would say, initially failing to issue a written Order until I journalized its absence.


In Mary Ryan's case Ryan v. Krause 11-CV-037, as you can see from the thumbnail, she did it ostensibly because Judge McAuliffe recused himself, but that's not really the Story. The Real Deal is the FACT that she is married to the mob, so to speak, in the sense that her husband, as a teacher at St. Thomas Aquinas, is a long-term wheel man for the Catholic Enterprise, errrr, Diocese. So anyway just as in my case all of NH District Judges are out. Judges Laplante and McAuliffe took powders back around 1 March, 2012 as I publicly questioned Judge McCafferty's failure to do so. So Plaintiff Ryan, who has eschewed a hush-hush payout, has already exhausted her panels in Rhode Island and in New Hampshire. Next comes Maine, stay tuned for the chilling conclusion of this episode of Little Person v. the System. Speaking of exhausted, I am exhausted just keeping up!

KingCast Motorsports Exclusive: Cody Eller Motorcycle Road Rage Trial set for 20 August, 2012.




The sentencing hearing is allegedly in February. The Motion for New Trial/Set Aside Verdict is still sitting in chambers with an attendant gag order. When you search Pelham Officer Eugene Stahl on this page you'll see the issue. The Union Leader is well aware of the issue and I may mention it next week when we tape Kevin Avard's show in Nashua: The Laurie List debacle is a matter of public interest, and with 60 cops on that list it is a game of Russian Roulette as to when one of them is going to potentially expose the State to some sort of liability. As I note in the video I am disgusted as a former State Attorney, as a former criminal defense attorney and as a past current and future motorcyclist. Anyway here are the State's closing argument segments that I caught on video, and you can clearly see that there is a heavy reliance on Officer Stahl's testimony and credibility. Too bad in the Saviano case a DUI charge was dismissed because of Stahl's conduct in questioning the suspect at the scene.... a similar issue to what is going on in the Cody Eller case. And from what I understand there is yet another more recent case that landed Officer Stahl on the Laurie List.

I say from what I understand because Cody Eller's Motion for a New Trial and to Set Aside the Verdict has been sealed and gag orders on the attorneys are in place. I find all of this to be completely unconstitutional and if I find the time and money I will sue over it. 

The Union Leader has no excuse. They have the time and they most certainly have the money. So where is the intellectual fortitude and Fourth Estate Integrity? On to the closing argument from Kent E. Smith, who is a heavy in the DA's Office.
