And it is going to be a very public affair, I'll be making a visit to some of your offices at some point to get your side of the story on video, again not that you have any defense.

I'll bet it's Ekert Seamans' Dorothy Davis..... see when I lived there I had great times jammin' out at Moondog's Blues Bar and grillin' up my infamous salmon pasta dishes for folks like Cherylann Hawk Band (make sure to listen to the updated version of Midnight Sunrise, awesome track) Dave Granati, etc. and eating sushi straight from the source at Wholey's Fish Market. I worked a lot of contracts on the larger office buildings, jammed a lot of music and ate a lot of sushi but thankfully never came across anyone as fishy as Dorothy Davis and her crew, basically a criminal element masquerading as upstanding ethical attorneys. For shame, for shame.

KingCast sees Judge Paul Barbadoro dismiss Federal claims in Kenney v. Franconia, Greg Floyd, Bruce McKay et al., 2010-CV-181, rewarding police abuse and McKay's violations of protocol.

More on this later and a Motion to Reconsider may be planned. It is hard to get Justice anymore in America and especially in New Hampshire where the Courts 99% of the time agree with Law Enforcement, big business and banks. What is especially troubling in this instance is that Caleb Macaulay is not emotionally in a position at this point to issue his Affidavit as to McKay's true actions that day are not admissible. Even at that, however, retired Franconia Officer Bradford Whipple's Affidavit was enough to survive Summary Judgment.  See also this journal entry for a summation of the lies and coverup in this case and this journal entry for the lies and coverup about Greg Floyd that disappeared from the Internet until I replaced them.


The Decision disregards the manner in which the OC Spray was deployed and downplays the Tahoe bashing as well, when in point of fact the seven (7) protocols that Bruce McKay clearly violated may indeed provided enough basis for a Jury to assess liability for Constitutional violations. The specific protocol says McKay was never to overtake or to ram a car and that if the identity of the suspect was known he was supposed to let him go. McKay overtook, rammed the car back out of sight and did not let him go yet he sure as hell knew his identity. The Court did not address those facts and simply usurped the function of the Jury, which is to decide whether or not those actions rise to the level of a Constitutional violation.


Instead the Court just said that those actions were permissible (which they clearly WERE NOT permissible) but that is once again his opinion, which does not comport with the neighbor's opinion when they described the situation in Kelly Ayotte's own so-called "Official Report." Read it right here in a 29 June 2007 Journal Entry entitled: "KingCast and community members say Bruce McKay was a bully; Liko Kenney died 800 feet from his home at Tamarack Tennis Camp."

The grey car was not going fast. I thought [McKay] was trying to get around it [for something else]. He made several movements (her daughter called it a "10-point turn" in her interview) to come nose to nose now facing north.... [McKay] pushed him and kept pushing him down (into the gravel area) dirt flew back the police car pushed him so strongly and just kept pushing and pushing and pushing until the grey car was beyond my view."

Court a reasonable Juror find that McKay doing all of this -- allegedly over an expired inspections sticker but more accurately out of a history of demonstrated contempt for Mill/Kenney -- rises to the level of a Constitutional deprivation? Of course. But we might not get to find out because the Court overstepped its bounds. Not only that, the Court wrote that it was unclear what further discovery would reveal as it slammed the hearsay statements presented by the investigator. Well wait a minute: Perhaps further discovery would give Mr. Kenney's lawyers time to interview more witnesses to what they have seen McKay do and their attempts to file complaints about him that went ignored, which is the whole point in a custom and practice Monell/42 U.S.C. §1983 lawsuit in the first place.


The State Law claims including wrongful death may be tried in State Court.

Wow..... this is some heavy-duty stuff here. I've been a bit remiss in talking with Mr. Pisano as I was focused on other matters between Boston and New York, and covering his fight against a new apartment building going up on contaminated land as seen in the short film on top. I did however reference this termination back in my first journal entry when former Chief Terence Reardon took a powder. I do not have a copy of the Complaint yet but he emailed me a copy of the cover page and I will publish a copy of the Complaint as soon as I get it.

It is heavy because the accusation is that he was taken advantage of because he has suffered a brain injury (when beaten as a child and left for dead) and fired without a hearing amidst bogus criminal charges because he was a union organizer. I see that Defendant Michael Murphy was scooted out of his position as Revere Captain and bound over to Police Chief of the bedroom community of Boxford, where my client Omnipoint couldn't get a wireless facility installed at any cost. Defendant Todd Randall (yes THAT Todd Randall) is doing soft time at club Fed for lying to FBI agents and awaiting sentencing for smacking local reporter Richard Ireton in the head at a Dunkin' Donuts franchise. And oh, former Mayor Tom Ambrosino is now the HNIC at the Massachusetts Supreme Judicial Court. I can't wait to watch this all develop in KingCast/Canon 60D 1080p vision. Growing up I watched Woody Allen's ex-wife Louise Lasser (she was kind of a hottie in her own way) in Mary Hartman/Mary Hartman but that show has got nothing on Revere I'll tell you that much. As to Mr. Pisano's land use issues, let's journey back to 2006 and another profits over principles case in Norwood, Ohio shall we? 


Anyway, I'll be certain to capture every court skirmish, the same way I got this one in the Joanna Marinova v. Boston Globe Defamation case:

KingCast watches Judge LaPlante take a recusal powder in Catholic Diocese case of Ryan v. Krause, but why didn't Magistrate Landya B. McCafferty?

1 March 2012 Update: Judge McAuliffe takes a powder because he has worked with Court Clerk Ann Mulvee, who is married to a Defendant, Bishop Robert Mulvee. See the thumbnail of the 27 Feb Recusal. Now here's the kicker:


1) The Order from Judge LaPlante directing Magistrate Judge McCafferty to carry out tasks isn't worth the paper it is printed on because he is acknowledging by way of recusal that he doesn't have Jurisdiction, got me?


2) Why is it that Magistrate Judge Landya B. McCafferty (who held Court as NH Attorney Discipline Tzar) is not recused given her marriage to someone intimately involved with the Diocese and St. Thomas Aquinas School? 


Answer: Because I already busted her for not recusing on my free press case, KingCast v. Kelly Ayotte, NH GOP and Nashua PD 2010-CV-501. And you know what is even more ridiculous? When I moved to have her recused for having worked for my opposing counsel at McLane, Graf (where Kelly used to work and where her mentor worked) Judge Paul Barbadoro wrote that my Motion "was entirely without merit."  May the record reflect that Judges never recuse themselves when there is no merit to the allegation. 


Then, when Judge Barbadoro refused to void her Order based on my argument that the conflict obviously existed prior to her hearing my TRO matter I asked him to certify the Order for Interlocutory Appeal and then he took a powder. The Courts are a hot mess, but don't get mad at me, I'm just your humble narrator. And yes, I know exactly what the hell I'm doing in and out of a courtroom, contrary to the wishful thinking of my detractors.

More on this later but here is your back story, and a bit more about Judge McCafferty and Judge Joseph LaPlante, who is clearly enmeshed with the Catholic Diocese in its fullest extant. As you can see the Court has completely failed to address the McCafferty portion, instead noting that she shall "perform such duties as may be assigned to her..."

21 Feb 2012 update: 

Even though new, reported cases over time will show that the Andersons' case changed the law in Maryland, they were denied any and all benefit of the decision and the Court basically screwed them over, royally by merging the Deutschebank entities and falsely stating that the Andersons acknowledged that one of these entities held the original documents. The Maryland Amicus Court Review published this nonsense hook, line and sinker p. 5. Read the Motion for Reconsideration as filed, below. Here then, is the cryptic decision and the order of costs to boot:
 

Says Mr. Anderson:

"They lied to the Bankruptcy Trustee and to the Court.... It was just a servicer at the onset, Saxon. Deutsche was nowhere around.... There are two different Deutsche entities, after a while they claimed it was Deutsche America -- but it wasn't.... They then filed a bogus allonge some 9 months later, saying it was Deutsche National. 

"Now they have already sold the house and ratified this, but they have made the same mistake all the other courts have. The Court of Special Appeals and the next court have both issued wrong opinions, so they are going to have to address that. We've got them all in a box, they can't issue contradicting affidavits in BK and in the Court of Appeals."
