Stay tuned throughout the evening and morning, the transcript from the Marinova case denying Summary Judgment is ready and boy is it a doozy, I will post it. You can tell from the get go that it was going to be a Bad Day for the Herald and Jessica Van Sack, just as I have stated all along. Now we wait for the other shoe to drop on the so-called confidential sources. From the Court: "The booted statement implies a much more serious and strong action was taken against her for much more substantial reasons than was actually the case..... I do not think these allegedly defamatory statements were protected by the fair report privilege. They appear to be based on official documents and actions. And as I have indicated, I do not reach the question of malice. However, I think that they were, for the most part, neither accurate nor fair. They were not substantially correct accounts of the proceedings. They were not -- or pardon me -- They were edited in such a fashion as to effectively misrepresent what occurred and to be effectively misleading. The disciplinary report itself does not suggest any action was taken against Ms. Marinova. The disciplinary report itself states that the engaging in sexual act charge against Mr. Jones was dismissed indicating, obviously, that Ms. Marinova did not engage in any sexual acts with Jones. For the same reasons, these statements were an unfair report because they mischaracterized what the disciplinary report stated actually occurred.
With respect to the memorandum by email to the Deputy Commissioner of Superintendent O'Brien's phone call with her, they are not substantially accurate reports of Superintendent O'Brien's report. The Superintendent's report never said words to the effect that Marinova had been caught or written up for engaging in sexual acts with Jones....... It's difficult for this court to conclude that the fair report privilege is well served if the reporter ignores a document in her possession that reveals an accurate picture of official action. I am speaking of the disciplinary report.....

As to my Free Press racial First Amendment case, my diligence and pleadings have forced all of the NH District Judges to recuse themselves rather than to cover up the obvious procedural and substantive transgressions manifest against me by McLane, Graf and former employee Magistrate Landya B. McCafferty and Judge Paul Barbadoro. So off to RI we go! When we get there Judge John McConnell, who graduated from Case Western Law School 10 years before me, will preside. Before he got to Case he graduated from Brown in 1980 with Columbus' Judge Maynard, a childhood friend of the family from Hawken School. Will they move to recuse him, I had much more than that on Judge McCafferty LOL.

Klein, don't forget the ongoing malpractice case over in Woburn CV-2007-02625 against Attorney Eric Karp, who arguably screwed up the child support agreement between International Felon, eMusic CEO, would-be Spotify rival and Columbia adjunct professor Adam Klein and Ms. Khan. Klein, btw has seen his daughter less than 10 times in 20 years, is basically a sperm donor and "deadbeat dad" to her, as noted in the linky up top. See they keep the child support case "impounded" as
one of those select cases from a short period that belies the common trend in these cases but much of it will come out when I take the KingCast cameras over to the malpractice hearing because Ms. Khan is entitled to testify about the measure of damages she has incurred because of the alleged malpractice. And let's not even get to the Frank Kinzie lawsuit, I have to look into my storage to get some old docs on that but it was a follow up to where Adam Klein embezzled, stole or otherwise misappropriated funds from Boumat, Ltd. before falsely claiming he was a political exile, nice. A Day of Reckoning is going to come when I show up at Columbia next week to ask them why they continue to employ this guy. And it's going to come on the end of my Canon 60D.

Now Judge Sargus did issue a sanction against me that I still believe was unreasonable. I had Conspiracy charges against Columbus Public School officials (now subject to NCLB Fraud investigations that POTUS is reading about, my Justice for Kids partners and I had a hand in that) and a Principal, Mary Jo Vagnier.
She did a number of things but most importantly allegedly used excessive force against Christian Minnis, a young black child.
A neighbor sent me a picture of recently retired Board member Thomas McCormack's Corvette in Vagnier's driveway early in the a.m. and I argued they were obviously friends and that may have influenced the Board to overlook issues that caused the Board's own consultant to recommend that she be removed.
I got sanctioned for that.
Meanwhile rapes went unreported and the Superintendent Gene Harris caught a "No Confidence" vote, unheralded. It's all in this journal.
