KingCast tours the Chelsea and Quincy District Courts, turning up cocaine issues in both.

NOTE: I'm going to scan the docs tomorrow or re-shoot them.

I'm still not sure how I'm going to write the Chelsea case yet (Daniel Talbot's last official act) so for now enjoy the picture of my lunch at Chelsea (that restaurant is delightful) and the radio segment below. What I can tell you about the Quincy "Road Rage" shooting is that Jennifer Bynarowicz was 100% definitely blowing rails. She said so in the police narrative.

The Probable Cause hearing was set back to 22 April 2010 today over Defendant O'Connell's objection. I've got the docket copied and all of the witness statements. The whole thing was over in 10 seconds, according to these statements. Ms. Bynarowicz refused to tell the interviewing officer where she got the marching powder. She might be under marching orders to do so at some point.

At this point Joey Fasano and Ms. Bynarowicz are not charged with any crime whatsoever, despite the fact that cocaine was in her car and she flat out admitted "It's my stuff...I was partying" and cocaine was allegedly on Mr. Fasano's face.

David Traub from the DA's Office telephoned me to say he had reviewed my radio segment on the matter and would be back in touch on Friday.

PS: Darkness himself is coming to Boston soon. Too bad Rick James can't be with him, but we can at least share in the video......

Remember, there is a jackass who lingers here who said I had no basis for saying that Joey Fasano had cocaine on his face.

There are but two ways that could have happened, let's see how it plays out in court as I can't wait to see how everybody spins this.

Trust me, this case has more turns than Deal's Gap.

Now those cats can RIDE. A good friend of mine was David Sadowski's lead mechanic when he won Daytona, and trust me I'm sure these guys have pro AMA licenses. Simply badass.

Watch for the DA's Office to say they cannot comment on the failure to press Cocaine charges against Fasano and Bynarowicz because it is part of an ongoing case.

But really, it isn't..... because they've never been charged there is no underlying case.

Just sayin'.

To sum up:

Fasano is a hero.

He may be a troubled hero.

Cocaine was involved and charges must be filed against at least one person if the State is to maintain the semblance of professionalism and fairness under the Law.

We still don't know if O'Connell has any relevant history.

I will be in the courthouse as a citizen and as a card-carrying member of the press to report anything and everything I deem appropriate.

Thank you for the prompt response.

Naturally I figured as much on the non-charge but really isn't it going to be in front of the Jury one way or another?

I honestly think that you gain more credibility by going after the cocaine charges and removing any question of partiality toward the firefighter and his lady when she already admitted being high and lied to the reviewing Officer about her whereabouts for two (2) hours.

Are you picking up what I'm putting down?

Just my $.02.

I tried to call 617-543-8085 but your voicemail at that number is full and not accepting additional messages.

I was able to speak to the superior court ADA handling the O'Connell matter this afternoon.

Although your posts are correct that the DA's office is somewhat limited in discussing the details of the shooting and the investigation with the O'Connell prosecution ongoing, I can confirm for you that the Quincy Police communicated their charging decisions to us in the days following the shooting and following the arrest of Mr. O’Connell and this office understood those decisions as being necessary in the context of prosecuting the Assault to Murder charge under 265/15A/A. More detail on that will likely become public as the case unfolds in court in the coming months.

Also, in the radio spot available through the blog you gave me the address to review, you had questioned whether the $500,000 cash bail set in the O’Connell matter was inappropriate. As may or may not have been noted in the docket you examined at Quincy District Court, the DA’s office had asked the court to hold O’Connell without bail under the Massachusetts dangerousness statute.
