Dan Talbot murder trial 2 Feb. 2010 -- Verdict at 2p. -- Jury says Robert Iacoviello and James Heang are Guilty.

Meanwhile...... interesting that the Globe does not allow for public comment on this very public issue, no offense intended whatsoever to Maria Cramer, it was enjoyable to work with her on this trial.

More on Derek Lodie.

Sooo......
After more than two years of heartache and 2.5 days of deliberation, closure has arrived for Patty Talbot in the form of Guilty Verdicts against Robert Iacoviello, Jr. (Murder 2 and Firearm possession) and James Heang (Accessory, NG on possession). No charges brought against Michael Picardi due to "prosecutorial discretion" as noted in the above video, even though the State knows that he was the chief mastermind in disassembling the murder weapon.

Sentencing will come at a later date per request of the Defendants, and victim statements will be taken later as well. Seated next to Ms. Talbot, the Victim's advocate told her "Both Paul and Connie said the same thing, they're not ready."

Ms. Talbot -- with whom I have a cordial rapport, despite what you haters have to say -- was sobbing throughout most of the courtroom verdict procedure and unlike other reporters, I didn't bother trying to ask her for a comment, it's just not the Right Time.

It was a hotly-contested case and there will be hotly-contested appeals based on the issues I have set forth in this blog, and some others. "He didn't do it, and we will appeal to the SJC," offered Defense Attorney Peter Krupp.

Wherever that leaves the State and the Defendants and the families is neither here or there at this point, but what is here and there for us as a society to think about is the fact that Youth and LE had better start acting in a more mature fashion out on these streets, or tragedies like this one are bound to repeat themselves.

Also, I was correct in my analysis, 100% because the Jury did not find for Murder 1:

Another lawyer got on the elevator with me today at lunch break. We look at each other and nod. There is a long, hard blink between us and we almost immediately knew each other as former LE Attorneys watching a horrible case. There was silent communication between us that what happened is a shame all around. He broke the silence first.

"That's gonna' take a lot of rehabilitation there," he said, speaking of how dinged-up Krupp left Papandrea on the witness stand.

"I know, Man," I responded. "That was pretty ugly in there."

"You don't get to murder one on that witness, no you don't."
*******
I'm still not clear how we got a Murder 2 charge on the table, and if Krupp did not ask for it that may be part of an appeal.

Related post: Closing Arguments. And to you haters, I would have recorded the State's closing argument as well, but with major media there I was prohibited, this matter was addressed and everything is okay now, I spoke with the Chief Bailiff, but more rules will need to be crafted.
PS: At top, two of my favorite pictures of the lead warriors Krupp and Edmund Zabin -- but also dig the big picture of Zabin next to Channel 7, catch his parabolic reflection in the eyeglass, nice.

The Jury saw through all the BS that was thrown out to them. They used clear judgment and found a verdict of guilty. Thank God for justice.

And now the Golden Moment, what was my internal belief?

I thought it was going to be a hung jury, 50% and G - NG 25% on either side.

Do you find it at all strange that Michael Picardi wasn't charged with a single thing despite Gia Nagy's plea being conditioned on her direct statements that she assisted him in dismantling what the Jury found to be the murder weapon?

Michael Picardi may be an informant the State wishes to continuously use.

Probably won't be of much use henceforth.....

I was looking for serious information on this case and came to your page. You may have some important issues that need to be addressed. However this blog is just rambling.

James: Put down the hash pipe. This blog has more information, exhibit pictures, video and legal analysis of the salient issues than you will find anywhere else.

Have a Good Night, Sir.

Richard Ireton at North Shore Tab was searing in his condemnation, and I must say he makes a point here on the M1-M2 bailout: I quote in pertinent part:

Let’s role play for a minute.

Let’s say Dan, I’m a cop and obviously I support the death penalty for killing cops. As a cop I would be very wary of what you just said publically…actually, I’d be very concerned.

You see it’s really simple Dan, you told everyone over the last 2 ½ years there was enough evidence to get a murder 1 conviction; premeditated murder is what you and Wark said.. You both repeatedly assured everyone that it was a premeditated murder…”an ambush,” I believe is what was said.

Now you’re “okay with a murder 2 verdict?” And that’s based on the facts of the case, facts that you and Wark said were solid? The fact is, what you meant is that you could just as easily lost because of the evidence…isn’t it Dan.

chris, thanks for the coverage of the case. at any time did the prosecution put the gun in iacoviello's hand other than other deal making gang member's testimony.ex: fingerprints, dna. just because someones girlfriend's dna is on the gun doesn't mean the boyfriend is guilty. from your coverage, if i was a juror, i have doubt he's guilty. thanks, m.c

Do you think Krupp really believes in his heart that Iacoviello did not kill Talbot?

Do you think Zabin believes in his heart that he did?

Chris. It's obvious you are very disappointed with the verdict. You would have got much more mileage with an NG. Your anti-police agenda is obvious in your postings and history. Agitate and blog, repeat....

As if I am the cause of the agitation that has been brewing in Revere for decades.

Nah, I don't need "mileage" out of this case or any other case. This blog is not used to generate revenue, I've got other things I do for that.

I had no horse in this race my friend, I'm here to report the facts and that is what I did, gave more videos and more trial exhibit pics than anyone else.

No, what disappointed me in the trial was DA Conley's unprofessional actions and what to me is a very apparent staging regarding the trash can shell casing by Bill Soto.

Simple question for you, yes or no:

Do you believe that casing wound up there on its own or not. Yes. Or. No.

PS: I complimented DA Conley on another trial that was going on next door.

PPS: Someone who was there has a different view, and sent this in from their mobile phone:

From the DA Conley "I don't have to talk to anybody" post.

MR CONLEY, AT A MINIMUM YOU OWE MR KING AN APOLOGY. I WAS STANDING BEHIND JAKE WARK WHEN YOU WENT ON YOUR LITTLE HISSY FIY. YOU REPRESENT THE COMMONWEALTH OF MASS AND THE PEOPLE .I FOUND YOU TO BE ARROGANT AND UNPROFESIONAL. YOU AND YOUR COLLEGUES WERE SO HAPPY TO CONVICT THAT WANNA BE GANGBANGER. IT SHOULDVE BEEN MURDER 1. INSTEAD YOU PUT COPS WITH AMNEASEA AND A DRINKING PROBLEM ON THE STAND. BOTTOM LINE. ALL PARTIES INVOLVED ARE GUILTY . BUT ONLY 2 PEOPLE ARE IN THE CAN. WHEN ARE THE COPS GONNA BE HELD RESPONSIBLE FOR THERE ACTIONS. ONE MORE THING. I HAD TO BAIL OUT A NEPHEW FROM THE REVERE POLICE DEPT. THE CHARGE PUBLIC DRINKING AND DITURBING THE PEACE. I BELIEVE THE POLICE DID ATLEAST THAT. MOT TO MENTION.DRINKING AND DRIVING.
