Veteran Franconia and Sugar Hill Officer Brad Whipple discusses Franconia and NH AG Kelly Ayotte's "culpability" and "malfeasance."

"These were complaints that were filed with the Chief of Police, with the Board of Selectmen, with Kelly Ayotte the Attorney General and the amazing thing was nothing seemed to have been done....there are several people who are culpable of malfeasance because with the information they had on this guy they had to say, get him out of uniform, get him out of service, he doesn't belong in it.... Five years almost to the day before this happened I met with his superior in Franconia police department and said 'get rid of this guy he's a danger to your community.'

If the facts had been allowed out by the Attorney General at the time, I think a lot of people would have fallen to the other side of the opinion poll and seen McKay for what he was."

You haters -- especially the NH media -- want to keep this message down, well we're not keeping this message down. Unlike Floyd's specious (and false) claims about making "43 kills" and being in a special "NSA -- No Such Agency" branch of the Marines (he was a water boy at Camp Lejuene) Brad really WAS a special ops/intelligence officer, and he and I agree on about 95% of everything I write here.

Now as for Attorney Mark Sisti -- for whom Brad originally worked on this case and the man who was allegedly representing the Kenney family -- I'm friends with Davey and Michele and there was never any written contract whatsoever. I'm going to leave it at that for now.

I don't know why Casey did not mention more about McKay's issues, including his own fire department filing complaints on him for him threatening them. Casey's work and my work were 99% independent. The most important thing -- when you get down to brass tacks -- is that we both, along with Brad Whipple, demand a real and further investigation.

PS: And thanks for reminding me Bill -- I have my entire disciplinary hearings on VHS and when I ask that BLACK jurist Guy Reece "what did I do at the Stewart trial that was unprofessional" he had no answer whatsoever. In point of fact that judge had intentionally misapplied the Dead Man's Statute to try to shut my case down. I also heard that judge talking with opposing counsel ex parte about my probation, all ridiculous and potentially unethical activities. That's what tenured Professor of Law Lou Jacobs (who has a cafe named after him at Ohio State's Law School) was writing about in his recommendation letter. When I gave a copy of my trial to Shirley Mays -- another BLACK sell out jurist -- for review and professional critique of what or how I was allegedly unprofessional she threw it out and never reviewed it.

You want me to addrees the issues fine. I watched Whipples video and comments.

Brad Whipple is incorrect about the restraining order in regard to weapons.
The order filed was a 14 day temporary restraining order NOT a permanent one.
There was never a permanent restraining order filed against Bruce McKay. Had there been AND ONLY THEN it would have made him ineligible to possess a firearm, permanently.

If a temporary order is filed "personal" weapons have to be turned over. This would NOT include his service duty sidearm, which could be secured in the Franconia Police weapons locker.
Cpl. McKay could have been given temporary desk duty assignment usual (SOP) until the case went back to court.

Furthermore any personal firearms taken are returned IMMEDIATELY upon the courts dismissal/or upon no further action of the case, by the courts.

The misinformation that is generated through your blog by you and others is what takes away from any potential credible claims made by you or anyone else. I told you the same thing 2 years ago.

Too bad you left out a few things, and you ASSume others.

First off, the public has no proof that the Restraining Order was only temporary, but it is alarming in the first place.

Second, you conveniently forgot to mention the other complaints that Brad and I discussed, including the knife to the privates of Ms. B.

Ms. B also told Franconia that Bruce was a danger to the Department and to himself and others, remember that?

Of course you remember that, but all of that fatty meat between your ears allows you to selectively block out the really important things.

Not to mention the complaints issued by Francoia Fire Department personnel who ALSO felt threatened by Bruce McKay and that the Franconia Police Department "Let them down."

The restraining order was alarming in and of itself?
Shall I post statistics about how many false restraining orders are issued on a daily basis. Judge Stevens has written several rulings on how severly flawed the domestic violence procedure is. It clearly states on DV petitions that the information and statements given are under the pains of perjury, yet no complainants have ever been charged with perjury for filing a false petition, even when the judge knows beyond reasonable doubt that the petition was false.

Neither you or Mr. Whipple have any proof the restraining order was a permanent one either, as a matter of fat originally in your blog and in Topix you did in fact state it was TRO.
Now you claim it was a permanent one and you and Mr. Whipple are running with that. I for certainly have to question Mr. Whipples motive for spreading misinformation as a former police officer.
I don't find what Mr. Whipple is doing any different than your misinformation you have published claiming Gregory Floyd is a 3 time felon which he is not. Or that your "reliable source who's never wrong" recently saw M. Floyd out and about in civilian clothes (you never did post a retraction that Mr. Floyd was not out and is still incarcerated until March 2010).

You are nothing but a distributor of assumptions and misinformation, and your credibility is in the tank.

FYI: I have been in the Boston area since last Thursday to bad you missed meeting me.

Be careful of what?

I already told folks a long time ago that Junior was just like his pops, a thief. Virgin Mary statues for daddy and some Wal-Mart money for Junior.

And as far is the rest of the personality similarities, Junior is still probably stealing things, right after he was in a local store recently they discovered that one of the Anti-SB154 Citizen complaint forms was missing.

As to his stalking-type activities, I know M*****e, she already told me about that.

And violence can't be far behind, but if he rolls up on me in a threatening manner I'll see to it that he gets to know the purpose of a hearse.

Get on with whatever you need to get on with to get me the memo, I've got some definite ideas about that one :)

Also, was it you on the Barrett issue?

If so, you seem silent on the issue of Justin Jungle Monkey Barrett... you said he was never fired but then I showed you the BPD press release so are you calling Commissioner Davis a liar, or not?

Never heard of justin barrett and don't really care. My issues are with the Franconia tragedy only. My problem is with you and the way you a trashtalking a dead peace officer. I personally have interacted with cpl. Mckay and have found him nothing but professional. I have never called for another unit without mckay showing up. Despite whipple he was and always Will be one of us. Never did I see whipple on an assist and that angers me. My other issue is landry. We call him the one who goes the other way. Everybody hates cops remember that.

I just looked up justin Barrett. Since your a stickler for sop. He was a probationary officer. Therefore he was not le and cannot be considered one of us, 3 days on the job? All of cpl mckays actions fall under the umbrella of officers safety and discretion.

Third is the Attorney Watts' Motion to Suppress and it is something I said a long time ago in the Sarah epiphany post: McKay violated Sarah's Civil Rights in his approach.

26. What Corporal McKay did not do is offer any justification as to why he was asking the defendant out of her car. He did not ask her to step out for a sobriety test, and as stating in his report, there was no request to step out of her car for a sobriety test. On these facts, the only basis upon which he could have forced the defendant to leave her car involuntarily was if she was under arrest.

27. The Corporal, however, does not metion the word "arrest" in requiring of the defendant that she exit the vehicle.

Fourth, in Sarah's Affidavit she claimed that McKay gave her a pen and kept demanding she sign a document without telling her what it was and she couldn't read it well because of the OC Spray. He threatened her TWICE more in the holding cell with OC Spray: "He asked me to return the 'weapon'(the pen). I was again threatened again that I would be pepper sprayed, and 'this time it will be worse."

Just like you I was not there for the altercation between Bruce and Sarah therefore I cannot comment. I wish i was however. As far as bode, you cannot cite an operator without being present. I would like to see that citation. My benefit of doubt goes with cpl. Mckay. I know the residents of Easton and Franconia have complained to me personally about bodies reckless driving. So I am assuming there is more to that story.
