KingCast v. Martha McLeod et al. Grafton 08-E-192 poses first NH Constitutional tests to RSA 611-B:21 and HB 4108.

Emails to a State Representative or Senator are allegedly not subject to FOIA and NH Right-to-Know? What a laughable proposition, oh, yah. So I'll effect service on the Defendants next week. I think my choice of process server is certain to unnerve a few people, but in a very constructive way. Someone said to me the other night, begging me to stop the litigation, "we're starting to heal...."

To which I say: "Yah, you're starting to heal in the sense that you can put lipstick and makeup on a battered spouse and heal those wounds right on up....."

* Speaking of who shot whom, don't forget that we don't even know if Anthony Jarvis was even armed but we do know he sure is dead, amidst a hail of what, like 22 bullets. And they aren't saying who shot the LE yet, either.
* Was it friendly fire, like that 1979 made-for-TV movie with Ned Beatty and Carol Burnett ("Your son was killed by friendly fire, ma'am....") or like the Concord credit union shooting at 4:30 a.m. where we know it was friendly fire because there was only LE involved (at least that we know of), even though they weren't invited to be there and the building wasn't even open to the public.
* Or was it like the walk-by shooting of Revere officer Daniel Talbot, in which Sgt. Michael Ervin fled the scene, left his service weapon unsecured and lied about everything, after he and everyone had been at least drinking behind the schoolyard bleachers at 1:30 a.m. This after an afternoon of drinking, mind you. Thank goodness they finally sacked him.

I have FOIA/RSA 91-A requests in on both of the NH cases, yah. I told some folks in Franconia very close to this tragedy that I'm not even seriously contemplating a book on this matter until the litigation is concluded and that could be years from now. I also told them I will call it "Letters to Kelly," and they approved with knowing smile.

Correct on McKay calling for back-up prior to even pulling off the road for the initial stop. With an obviously nervous Liko Kenney, McKay chose to not tell him that back-up was indeed on it's way, even as the young man repeated asked for it. McKay was on a power trip. Apparently, he was not satisfied with his amped up measures thus far to terrorize this kid. He mis-judged just how frightened he was of him. Sad state of affairs and should have been addressed by the town a long time ago.

Could not agree more !

It almost seems as if he enjoyed this....

It was not the first time as we have seen this in other videos/people/stops.

It is obvious that at the very least he had some serious issues with authority/control and abused the power given to him as an LEO.

PS: Dig the composition of that picture at the Littleton Staples today. Nice American flag thing going on, yah.

I would defend anyone's right to burn it, but I wouldn't do so.

What I will do is exercise my Constitutional Rights guaranteed by said flag with impunity.

The State was "on to me" when I handed them their collective arse a few years ago, although they DID manage to keep me from attending Tamarack Tennis camp, where I would have heard about Bruce McKay and duly made inquiry.

Lawsuit Prayers for Relief (partial).

a) Judgment compelling immediate disclosure of all requested emails from private account of Respondent McLeod, with a Court ORDER that her Private email provider search her emails for any reference to HB 1428 and provide them to Petitioner at Respondent’s cost.

b) Judgment compelling immediate disclosure of all requested emails from the public account of Respondent McLeod at her cost.

c) Judgment finding that the Respondent McLeod egregiously violated RSA 91-A by not even responding to Petitioner in the manner contemplated by Statute as noted in Law and Argument Section “A.” Note that while Speaker Noreli violated the response time Petitioner waives his argument on that because counsel did act reasonably in apologizing for the delay.

f) Judgment that the Town of Franconia violated RSA 91-A by failing to provide a copy of Citizen Complaint(s) issued in 2005 or 2006, as they have previously turned over such complaints for public inspection and they should be available for public inspection. The investigation itself is a separate matter.

g) Judgment that the Town of Franconia violated RSA 91-A by failing to provide a copy of the minutes in which the termination of Norman Bruce McKay was discussed both leading up to the vote of non-public session and in the actual discussion itself as required under RSA 91-A:3.

h) Judgment that NH AG Kelly Ayotte is applying RSA 611-B:21 in a manner not consistent with Constitutional guarantees of the Right to Petition the Government for Redress pursuant to the First Amendment to the United States and New Hampshire Constitutions, as the public is entitled to know of performance-affecting drugs and gunpowder residue both as a matter of course and specifically in a case like this with unassigned bullets.

Again, I have always liked the cohesive and linear nature of KingCast II. I told a supporter the other day that the first lawsuit was quixotic in the sense that there was just so much to try to address. But it paved the way for this one, and this is the one that goes to the Supreme Court of New Hampshire and beyond, if necessary.


The people of Franconia have met me and I think they are a good judge of character, so that's why we're throwing a party next Thursday.

The people of NPR are on to me too, and that's why they're coming up for 3 days.

Wonder what Lynn is doing with the hatred in her soul? I know she wrote some folks in Franconia and tried to get them to rail against me and they told her to get lost, quick fast and in a hurry.

One such person laughingly told me that when Lynn told her "he's arrogant," she said "well he's a man....."

See the thing is, S.S. was joking about that as it applies to me, because we talked for quite a while and we're always good, I can stop by and vist with her any time. Same goes for the family next door and the family across the street.

Deal is, I'm not arrogant.

I just do what I have to do.

And so do you and you do it faithfully:

Show up and show what a tool you are.

Healing is one thing.....Not everyone is starting to "heal".

Part of the mission here is prevention. Until the corruption is dealt with this will happen again.

The problems that led up to the tragic events of 5/11 remain. I will not sit back and allow for history to repeat itself.

Many of us would like nothing more then to forget this has happened. Some may choose to do just that. Others will not. Until the trauma of this event is processed (including why it was allowed to happen)any wound that heals will be temperary and eventually open up again.

Lynn has some issues !

What I find so funny is that she had so much to say about Sr's trial ( yes, the one in which he was found "GUILTY" of criminal threatening) but she slept through much of it.

There are a few folks determined to break the alliance. I would have to thank them because in fact it has streghtened the alliance and made so may of us even more determined to see this thru.

Yes the prevention is the other matter, and you know that letter I wrote to Martha McLeod almost a year ago to the day was all about Civilian Review Boards.


Yes, she sure does. I'll never use her last name as I did with Ditmar Kopf, the tool who lied and said I threatened to shoot him in the head, but we all know who she is and yes that is the silver lining of her and other's hateful antics is that we indeed are strengthened as we prepare to make our march on Washington.

Meanwhile, from what I understand, don't look for the interviews with Franconia's First Couple (or is that the dastardly duo) to be exceptionally warm or inviting.

As far as Martha goes I'm afraid we will have to ask her "campaign manager" she hired several weeks back. In my opinion he was hired to handle the pressure she can not.

She claims that she needs the services that this person has to offer but what she really should have said is.........

I messed up really bad. I have lied to the very people I represent and I can no longer handle the pressure of my deceit.

He may have the recipe for Martha's stew as well.

If she can not stand up to the very people she represents and chooses to run rather then shake a hand and answer a few question how will she ever stand up to other politicians as a State Senator ?

Gallus is not sweating this one out.

KingCast says the answer to that question involves the fact that most of her Senatorial duties would not be so involved so her transgressions and deceitful actions might be shielded.
