KingCast new RSA 91-A request goes back to Bruce McKay's incommunicado status on 5/11 when he violated policy while attacking Liko Kenney.

Dear Attorneys Ayotte, Mullen and Modigliani:
Please produce any and all documentation that would tend to show that Bruce McKay's GPS system, $2,000.00 Motorola XTS3000 2-Way radio or his Kustom Signals Eyewitness equipment was in any way malfunctioning at any time on 11 May, 2007.
So to recap, according to Defendant Ayotte's own report:

1. His $2,000.00 taxpayer Motorola 2-Way radio was on mute.
2. His taxpayer GPS was shut off but it worked fine in 2006 with Sarah_2.
3. His front seat/outdoor mike was shut off but it worked fine with Sarah_1 and it worked fine with Liko at Fox Hill Park in 2003.
4. He was AWOL/MIA from 6:09:15 to 19:16:02 when shot. [Note: This probably should have been 18:16:02 but their clock wasn't calibrated properly and also for consistency the AG's report should have used military time throughout so it should have been 18:09:15 to 18:16:02].

I do this because it will be easier to assemble the Petition for the U.S. House to open an investigation when the Franconia Collective files for review later this summer. This way the House may be able to more readily ascertain exactly where Kelly's review strayed from the Path of Justice, when this information is viewed in pari materia with the crime scene photos showing McKay's spent casings 30 feet from Liko's car (more analysis) and the 6 violations of pursuit and OC Spray policies, oh, yah.

Add-in #1: Then there's Kelly's lies all linked here.
Add-in #2: KingCast v. Ayotte suit shows McKay brutality.
Add-in #3: KingCast v. Ayotte suit shows Police Chief Montminy (and counsel Mullen?) willfully concealing relevant facts about Bruce McKay from Judge Timothy Vaughn.

See the House did such an investigation and found that the FBI framed Joe Salvati. BTW look at Barboza in Court, that's awesome. Totally awesome. Them cats wasn't no joke, boy. Survey says they flipped the photo on the left though 'cos you swear with your right hand. But of course he was lying so maybe he DID use his left!

You are getting very careless. For you to claim that his radio was on mute is baseless. For all the good research you claim to do, why haven't you taken the time to ask your Nashua police buddies how the Motorola radio works?

Anonymous said...

or for that matter just to google the radio and download their manuel! You mention two different cruisers, one is a car the other a SUV, I would venture a guess two different systems, but I haven't done nearly as much research as King claims (sarcasm),

I have spoken with a Motorola salesperson on that already. If he is wrong then he is wrong.

But guess what:

If Dan Mullen and his client would respond to my lawful RSA 91-A request for the manual we would be all clear, yah?

Here's this morning's reminder, or are you getting careless in your reading?

http://christopher-king.blogspot.com/2008/05/kingcast-outstanding-discoveryfoia.html

But I understand. Mullen is busy with his client trying to figure out how the dog at 65 pages of homework before I file with the Bar Association.

http://christopher-king.blogspot.com/2008/05/kingcast-ethics-query-on-dan-mullen.html

Is that what you mean by "careless?"

And yah, there are two different cars but likely not two different systems. In any event, that is why I just asked for (and repeat after me)

"any and all documentation that would tend to show that Bruce McKay's GPS system, $2,000.00 Motorola XTS3000 2-Way radio or his Kustom Signals Eyewitness equipment was in any way malfunctioning at any time on 11 May, 2007."

So that way we have it all clear before we go to the U.S. House.

BTW when Kelly wrote to Attorney Harold Burbank that "all of the witness statements were consistent," was she intentionally lying or just being "careless?"

http://christopher-king.blogspot.com/2008/04/kingcast-says-lets-not-forget-that-nh.html

Perhaps you can help me out on that.

Also, whether the Motorola salesman was correct or not, McKay was still incommunicado for more than 5 minutes, and the Kustom Signals salesperson and Kelly's own report indicate that his mike was off.

Maybe Brucie was just being "careless."

Either that or he was being very careful.... careful not to let anyone know what he was saying or thinking.

Perhaps you can help with that, too as you're in such a caring mood this morning.

New RSA 91-A requests on Bruce McKay's equipment on 5/11
Friday, May 9, 2008 11:21 AM

From: "Christopher King" kingjurisdoctor@yahoo.com
To: dmullen@ranspell.com, police@franconianh.org, selectmen@franconianh.com, Marta.Modigliani@dos.nh.gov, USANH.Webmail@usdoj.gov, david.frydman@leg.state.nh.us, Kelly.Ayotte@doj.nh.gov, Jeffery.Strelzin@doj.nh.gov, prosecuts@safety.state.nh.us....

Dear Attorneys Ayotte, Mullen and Modigliani:

There seems to be some confusion (still) over the events of 5/11 and what type of condition Bruce McKay's equipment was in and why he was incommunicado for more than five (5) minutes right before he violated use of force policy and so on and so forth, etcetera, etcetera. Toward the end of clearing up such confusion could you:

Please produce any and all documentation.....

Good Morning Mr. King,

I apologize for the delay in my response. I was out of the office all of last week. I have received your multiple 91-A requests and am in the process of reviewing and researching what documents we have that are responsive to your 91-A requests. I believe that I will be able to respond to your request by Tuesday, May 13, if not sooner. If you have any concerns regarding this, please do not hesitate to contact me at (603) 271-2791.

Regards,

Marta Modigliani

********

Dear Attorney Modigliani,

Excellent, thank you for the prompt and courteous update, which will entirely suffice. By the way I just sent you a new one, which is related to the first ones. When you have a response and/or cost estimate just shoot me an email and I will respond accordingly.

If only I could get the same sort of response out of the town of Franconia......

But then again that's why they have been sued and owe me court costs, and you have not!

LOL and best regards,

Christopher King, J.D.

Actually what's funny is that Barboza looks a lot like a friend of mine; they could be brothers =^.)

I don't think the "on mute" is a baseless claim. If you look at the photo of the digital display shows the word "mute". I see where you "perry Mason on topix) have explained a possible scenerio of what that meant, however the remainder of the dash cam video (15 minutes or more) AFTER Liko pulls away does seem to verify the unit was not broadcasting to the tahoe. There is little or no sound after that point (at least on the state-supplied DVD)except for intermitent sounds presumably from mcKay's shoulder mounted mic as the vehicle is lifted off and he is worked on. This indicates the Tahoe was recieving audio but nothing was broadcasting to it continuously (again based on the state's DVD). If the radio was not muted or at least not in a state where it would not trsansmit to the tahoe, would you not hear a continuous audio stream?

Just asking.

Exactly. And he was 5 minutes MIA according to Kelly's own report, which was the exact time of the drive'n'bash.

Which TOPIX thread is it? I couldn't find it.

Jeezlouise look at what happens when we give some LE too much time on their hands:

Columbian Cokane has the Low-Down rizzy-real on the Revere shooting in which Daniel Talbot appears to have been murdered as his dirtbag Sergeant Ervin Franklin ran, hid and lied about everything. It took Mayor Ambrosino some time to fire him but I'll let you pick up the action with him after this week's termination.

Also some links to my coverage on it can be found through here; I have always contended that they need to get up with some serious toxicology/drug/BAC results on Ervin and his pals because I think Talbot might have wound up in a situation to which his superiors may have contributed.

It is thematically consistent with the tortured tale of one Norman Bruce McKay, a rogue cop who once did some Good Things as an officer a long time ago.

G'day Chris..
4. He was AWOL/MIA from 6:09:15 to 19:16:02 when shot

Was McKay AWOL/MIA for 13 hours
on 5/11?

Anonymous said...

oh and anything new on McKays Medication?

Christopher King said...

No, it wasn't 13 hours it was 6 minutes but that was the way that the AG's report read and furthermore it should have read 18:16:02 but their clock wasn't set right.

Also, later today an LE buddy of mine will be reviewing this post and the Motorola picture and confirm or deny my suspicion that it was on MUTE, with McKay going the extra mile to make certain that dispatch did not hear him as he attacked Liko Kenney.

Stay tuned.

Still working on the MUTE question, meanwhile a point of clarification I sent out just now, Monday 12 May:

GPS Addition to New RSA 91-A requests on Bruce McKay's equipment on 5/11
Monday, May 12, 2008 1:04 PM
From:
"Christopher King" kingjurisdoctor@yahoo.com
To:
dmullen@ranspell.com, police@franconianh.org, selectmen@franconianh.com, Marta.Modigliani@dos.nh.gov, USANH.Webmail@usdoj.gov, david.frydman@leg.state.nh.us, Kelly.Ayotte@doj.nh.gov, Jeffery.Strelzin@doj.nh.gov,

To all,

It has occurred to me that I did not distinctly ask for the following:

Any and all manuals or other documentation that describe the GPS system installed in the Tahoe on 5/11, directions for operation, its manufacturer, serial number, etc. I had only asked for information tending to show that it was not functioning properly, which is a distinctly different issue.

I apologize for the confusion. Please write or call if you have any questions.

Very truly yours,

Christopher King, J.D.
