According to a press release from the Fish and Wildlife department, 2-1/2 pounds of marijuana was confiscated at Davis' home, apparently hydro: A subsequent search of her home revealed a growing room which contained 32 marijuana plants.

.....[Judge] Sand, whose statements last fall about the government's failed war on drugs and marijuana in particular garnered him national attention defended his decision and said it was consistent with other first-time offenders.

"This is a 60-something-year-old woman, who had no prior criminal history whatsoever and there was no evidence at all of sale, furnishing or distribution," said Sand. "I made the discretionary call in the interest of justice and referred the case to court diversion."

Face it.

The so-called war on drugs is utter BS; it is largely a cash cow just as any other war.

I have absolutely no problem with the sentance meted out to Attorney Smith, but I will add that if an ordinary 60 year old or 50 year old person with no criminal history got popped with that kind of plantation most anywhere in America, they would see a good piece of time, you bet.

I remember defending people who had 1/8 of an ounce in one baggy and the police trying to get them for intent to distribute.

Just shows how vague and capricious the Law can be.
