KingCast watches NH AG Kelly Ayotte peppered with Right-to-Know inquiry.

John P. is a smart guy, and earlier today he and I finally figured out the coverup of Shooter Floyd's actions, as noted in this post. How does it feel to get peppered, counselor?
"Also, in order for me to understand what material is available related to this completed investigation and incident; please direct me to where I might see a full and complete list of "ALL" material, documents, statements and any and all evidence that is available for purchase or for free involving this investigation and also "a list" of any material, documents, statements and any and all evidence that you may not be releasing publicly and the reason for these items not being released."

Dear Attorney General Ayotte,

As a concerned citizen, I am researching the "May 11, 2007 incident in Franconia" and have become aware that you have posted a document entitled "Final Report" on the state website (See: http://doj.nh.gov/publications/nreleases/062507.html).

Because this document appears to only include conclusions and selective paraphrased statements of witnesses; I request that you also make available electronically and for free the actual statements and accompanying material that this report is based.

Your office has clearly showed the ability to make documents available for free via the internet. So, I must assume the reasonable cost for these documents to be produced via an electronic method such as the internet or email would be $0.00. It would seem wrong that you charge for some documents and then selectively make others available for free. It would seem this could be construed as a way to limit the access of this information to the public. Although I am sure your office would not do such a thing and clearly wants the public to be aware of all the facts, you can certainly see how this conclusion might be drawn when you charge tax payers for selective documents and then only make available for free your offices opinion or findings of the case in an official report.

Also, in order for me to understand what material is available related to this completed investigation and incident; please direct me to where I might be see a full and complete list of "ALL" material, documents, statements and any and all evidence that is available for purchase or for free involving this investigation and also "a list" of any material, documents, statements and any and all evidence that you may not be releasing publicly and the reason for these items not being released.

Thank you for your time as I understand how busy your office is but also believe it is important that we as a society exercise our rights when it comes to these types of checks and balances and to simply be involved citizens.

Yes, the stricker is visible and from what I know you have 10 days beyond expiration to get your car legal and stickered. Expired 4/30, out of grace period on 5/11.

I'll let you draw whatever conclusion you'd like from this. My conclusion, it was known Liko's car was overdue prior to this day, and a mental note was made:

5/11 look for Kenney on 116 driving home from work. Wrong color sticker, BINGO, prey.

This conspiracy theory is supported by the fact another driver got a free pass from McKay minutes before Liko.

If my guess is true, this is not the way we want LE to be in Franconia, this is wrong.

What If pepper spray is shot point blank in someones face and the person has a prior condition like asthma??

(a chronic disorder characterized by wheezing, coughing, difficulty in breathing and a suffocating feeling)

isn't it possible that pepper spray is potentially lethal? OC + a Respitory problem is very dangerous! It didn't de-escalate 5/11.... Did a student go to the hospital when McKay used OC inside that school? Who paid that bill? Dont tell me the supreme court said tax payer OC in a school is upheld.

6:30 AM The answer is they sometimes die.

The cops now have so many "non-lethal" forms to make people comply to their commands that were originally sold as alternatives to using the gun. Now they simply use them when somebody doesn't listen and sadly not everyone can handle pepper spray or tens of thousands of volts of electricity entering their body.

Yet, we as the public have okayed their use to prevent police from having to use verbal commands or conversation to get people to comply. These people signed up for a dangerous and should be in better condition than the average Joe but every rule is designed to keep them safe and not the public in any encouter they have.

We have let them turn a pat down of weapons into empty your pockets whenever they come in contact with a citizen. Your rights mean nothing and all that matters is that they can use extreme measures to ensure their safety and avoid things like having mulitple cops wrestle an unarmed suspects hands behind their back. Instead zap him with electricity.

Here is an example of pepper spray on a fast food employee who the cop claims (incorrectly) short changed him...Note that he was cleared of any wrong doing....

Here is a UCLA Student (on medication for bi-polar) student without a libary card getting tased MANY times. He can be considered a passive resistor for not standing up and instead of the numerous officers picking him up, they keep tasering this person over and over. Note all the witnesses, imagine what the cops do when there are none...

If you allow an officer to have you empty your pockets, you are as much of the problem as the officer. Terry v. Ohio allows a terry pat, but the officer muct be able to articulate the presense of a weapon. CK can elaborate more, but the fourth amendmetn is one of the most import ideals set forth by the founding fathers. All eveidence gained would be inadmissible, fruit of the poisonous tree. And hopefully the judge would severely reprimand the officer for doing such a search.

7:50 AM - And will you be the one who stops the officer from reaching your pockets? Resist, obstruction and god forbid of you brush his hand away assualt. Do you have the money to go all the way to the supreme court to fight the case? Consider most judges are on the same payroll as the DA and Cops.... Interestingly enough so if the Public Defender though I don't hear our conservative leaders saying they should privatize or outsource that like they do when it comes to healthcare. If you think about it, what a conflict of interest. A court appointed lawyer should be one paid for by the state but picked by the defendant. What a joke it is that the people prosecuting you (the state) provides you one of their own to defend you.

Note: most Americans would go broke if having to defend themselves in any kind of serious trial that required expert testimony or if they even wanted one tenth of the resources available that the DA has, such as an entire Police Department to be used as private investigators .. not to mention labs, specialized equipment and unlimited funds (yours and mine).

I've been watching the info come out fairly regularly, here's my feel for it at this point;

1) McKay likely escalated the situation needlessly, but I don't think he was Dr. Evil; he supported Liko getting off lightly the first time. Very imperfect yes, not good material for a cop, but deserving to die? Don't think so...

2) Liko likely had some serious mental health issues; was it safe for him to have a .45 next to his car seat? No, as shown by the fact that it was stolen, and he then assaulted the kid that stole it. Was his family doing him a favor, allowing him to drive around with a cannon next to his car seat? No, not at all. Most of the responsibility rests on HIS actions, that's clear to see.

3) Was Liko ever compliant during a stop? Not from what I've seen from two incidents. Do you place your naughty bits in a vice when you don't comply to a cop? Yes. Fact is, the best strategy is to comply on the stop, and then fight back later, just a fact of life. Getting out of the car repeatedly the first time, bad sticker 2nd time and running, possibly speeding, if you want to stay "fuzz-free" the best method is to be squeaky clean. Did he deserve to die? No. Is most of the fault his? Possibly...

3) Floyd; disaster waiting to happen, BIG time. Possibly couldn't wait to have the opportunity to shoot someone. Scary that the girl that dissapeared was close to his house, definitely creepy. Then again, let's not get to crazy with the speculation, we wouldn't allow that to happen to "good guys" that we support. But Ayotte betting the farm on this guy because he killed a cop killer? Poor judgement there, my intuition says this guy might kill again, and then Ayotte's career is possibly over...

Final Analysis: This was a clusterfuck of bad timing, bad decisions, and bad fortune. Macho gone mad, mental health issues (in TWO of the people) contributing, resulting in tragedy. BOTTOM LINE: I think martyr treatment for Liko is getting a little thick here. You don't have to cannonize him to point out the bad behavior on others' part. BUT, all the info needs to come out on this. One day to clear Floyd is ridiculous, and missing sound and files that don't play look like breadcrumbs to bad behaviour in the AG's office, and they need to be SPANKED for it. But the good work here is getting stained by the effort to make Liko look like a total victim here when it's clearly not true.

Carry on folks, there's a lot of good work here, too bad it's being tainted by the martyrization of one of the imperfect actors...

You miss the substance of this blog entirely by thinking the state's actions are not premeditated, pre-calculated, unlawful and unjust public manipulation. The US Constitution is great ONLY because it applies equally to the "least" among us (accused murderers, psychopathic blood thirsty US presidents, etc).

The first National Bank of Franconia will never be robbed. I can bet on it.

The biggest crime up there is a cow getting out of a farmers fence and eating a neighbors raspberry bushes.

I didn't realize that a Police State of the country had infiltrated a small town like franconia. The police mafia has moved that far north? Yes they have.

Let's pick on teenagers who will eventually run this country?

Do your own research, go out and do a survey among 14 to 30 years old and ask them if they have been abused by police or know of someone in their age group that has.

This will solidify your answer.

Let's reduce the stats to 15 to 15 year olds. It's a lot easer to figure.

do your interviews with an age group from 15 to 25 year olds.

You will find that an "ocean elevens"
kind of injustice is well recognized in this age group.

the Vegas "card readers" you are referring to, were highly disciplined engineering students from MIT, and in terms of their mental capacity were light years ahead of dope-smoking, gun toting and silly-acting Liko. Read this:

The MIT whiz kids had more resources, training and attention to detail than the casinos had ever before encountered.

So puhleeze... there are plenty of brilliant young men and women in this country, and sure as hell Liko wasn't one of them.

Well Chris ... At least it is clear to see that you havce more juice than me with the AG as I have not even got a response to tell me when they are going to respond.

Will keep you updated but will fire off another email Monday if still no response. If she is on vacation you would think she would have an auto reply.

Just read a story on CNN.com titled: Astronaut's attorney: She did NOT wear diapers

Turns out there was some Toddler sized diapers in the car for a specific toddler.

When asked about the incorrect information in the police report....
An Orlando police spokeswoman, Sgt. Barb Jones, said a court would determine the accuracy of the facts.

Really? I thought the court decides on innoncence or guilt and not specics like this.

The point of the above post was acutally just pointing out another example of how DA's & Police have no problem getting false information out ... come on, either she was actually wearing diapers or had them in the car. If she was wearing them then certainly the soiled diapers will be in evidence but we know they won't be.

This was a misrepresentation that the entire world thought was true and they never thought they should clarify this untruth they spread.

It is just a plain miracle the DA in NC was fired as we have become a nation of careless people who watch injustice from our elected and hired employees and do nothing.

Even if Floyd, the cops, Mckay and the NH DA all turned out perfectly clean in this matter, I am grateful that somebody like Chris has helped make the fact come out because we in the public need to hold our leaders accountable and can only do that if we force them to be open and honest.

Caleb's Window Rolled up ...

If anyone wants to be sure that Caleb's window was rolled up, take a look at S19:16:30 as Liko pulls away after being sprayed and then firing on Mckay. It is clear as day in this video:

1 - Floyd's son testified that there was a delay between the two shots by his father.

2 - Liko was shot twice. Once in the neck and once in the head.

3 - Police state passanger window was fully up but the glass was shattered. (without a picture it is not clear if they mean shattered in place or if the glass they descrive bein in and out of the car was the window)

4 - Floyd Sr. says he reached into the car and fired at Liko while holding Caleb in place.

5 - Floyd states numerous times that he gave no warning before firing. The window being closed on the side of the car he was on indicates this to make sense. Caleb backs this up.

6- Floyd Jr. says his fathered fired twice. Sr. says he fired once or twice. Caleb says he fired more than once.

Basically Floyd admits executing Liko. The first shot either went through the head or neck and then he obviously reached into the car for the second shot (if he is to believed) and fires another shot.

Floyd Jr. says after his dad fired the first shot he then looked over his shoulder to see him fire a second shot.

So, Floyd did not quickly pump out two rounds but waited before shots and obviously had to move close to the car and stick his hand in to fire almost point blank

Where are they?? They would be crucial in knowing how far the gun was to Liko when fired depending on any powder burns to his neck or head.

HOW DID FLOYD STOP LIKO FROM TRYING TO RUN OVER MCKAY AGAIN???

The final report they claim Caleb says the car was headed towards Mckay again but also having him say it was stopped. Yet, the car was on top of Mckay when Liko was killed or there after as they had to lift it off him.

Did Floyd shooting Mckay cause his foot to come off the clutch and run over Mckay?

Was the car already on Mckay when he fired?

I have to assume that the car was a stick shift as it would have kept going when the they lifted the car off Mckay.

Both Mckay & Liko's gun were semi-autos and we saw how fast Liko got off his rounds. Why was there time enough for Floyd JR. to turn and look and see his father shoot Liko the second time?

There is audio on the entire tape, even if it is low. Why does every video stop before we can hear the shots by Floyd??

Surely gun fire would be picked up on the vehicle's microphine even if the one on the belt deactivated.

surely that's why they kept the evidence back for six weeks...1, hoping it would just blow away with their spin tactics and 2, covering their butts as much as possible while they doctored and destroyed evidence...

I agree that Kelly Ayotte has made this worse with every move from the day after the shootings. She has no human decency. You don't make decisions by whether someone is a police officer or not.

She has caused more damage than the shootings alone have done. She is spitting in our faces and we are supposed to provide this loser AG with a pay check?
